The City Manager may grant a permit to hold a retail merchants'
fair under the following conditions:
A.
The
permit is applied for at least 30 days prior to the date of the proposed
fair;
B.
The
permit is applied for in the name of an organization or association
of retail merchants;
C.
In granting
the permit, the City Manager may condition its use on conformance
to specified hours of operation, an agreement to retain special police
protection, an agreement to maintain in effect liability insurance
which names the city as an additional insured and such other conditions
as the City Manager deems necessary to protect the health and safety
of the community;
D.
Prior
to issuance of such a permit, the applicant shall produce to the satisfaction
of the City Manager evidence of indicating its license to sell alcoholic
beverages awarded by the state.

Under no circumstances shall the City Manager grant in excess
of four permits per year to the same retail merchants' organization.

The permit granted pursuant to this section shall indicate the
specific date for which it is granted and shall only be valid on that
date.
