The ordinance codified in this chapter is adopted pursuant to
Article X, Section 1002 of the Charter of the City of Stockton to
prescribe the qualifications and conditions of employment applicable
to the employment and reemployment by the City of employees of OMI/Thames
Water Stockton, Inc., the functions of which the City is reassuming
by court order.

A. Unclassified Service. The City Manager may employ or reemploy any OMI/Thames Water Stockton, Inc. employee in any position excluded from the classified service by Section
2.36.060 of this title or by any resolution of the City Council. The/City Manager shall determine the number and types of OMI/Thames Water Stockton, Inc. employees needed to provide adequate staffing in the unclassified service. Such employees shall be employed under the same terms and conditions as other similarly situated City employees.
B. Classified
Service. The City Manager may employ OMI/Thames Water Stockton, Inc.
employees in positions included in the classified service, without
the necessity of examination; provided the positions are determined
by the Director of Human Resources to be substantially equivalent
to positions the employees formerly held with OMI/Thames Water Stockton,
Inc., and provided the City Manager, in his or her capacity as the
Personnel Officer, is satisfied that the employees have satisfactory
records of performance in such positions with the OMI/Thames Water
Stockton, Inc. The City Manager shall determine the number and types
of OMI/Thames Water Stockton, Inc. employees needed to provide adequate
staffing in the classified service. OMI/Thames Water Stockton, Inc.
employees placed into the classified service under this subsection
shall be required to complete the probationary period set forth in
the relevant bargaining unit agreement or Civil Service Rules.
C. Reemployment
of Former City Employees. The City Manager may reemploy in the classified
service, without the necessity of further examination, any former
City employee who transferred to OMI/Thames Water Stockton, Inc.,
in accordance with the special agreement between each of the Stockton
City Employees Associations, the mid-management/supervisory level
unit, and the Operating Engineers Local Union No. 3 regarding the
transfer of wastewater, water, and stormwater services to OMI/Thames
Water Stockton, Inc. All former employees of the City of Stockton
(defined as designated employees in the special agreement), shall
be reemployed in the grade and position such employees would have
attained had they remained in the employ of the City or reemployed
in positions that are most comparable to their current OMI/Thames
Water Stockton, Inc. position. Designated employees shall not be required
to complete an additional probationary period.
D. The
Director of Human Resources shall certify to the City Manager that
all persons employed and/or reemployed under the provisions of this
section meet the qualifications for and conditions of employment,
comply with the rules and regulations of the Civil Service Commission,
and meet the minimum requirements for the classes and positions for
which employed.

Designated employees, as defined in the special agreement between
each of the Stockton City Employees Associations, the Mid-management/supervisory
level unit, and the Operating Engineers Local Union No. 3 regarding
the transfer of wastewater, water, and stormwater services to OMI/Thames
Water Stockton, Inc., shall be designated as "employees" for the sole
purpose of participating in promotional examinations for the Municipal
Utilities Department, in accordance with the resolution of the Civil
Service Commission adopted on December 5, 2007.

The Director of Human Resources shall designate the appropriate
step in the City salary schedule for each person employed pursuant
to this chapter.

Prior to the execution of the contract by the City or the completion
of the transfer, as the case may be, the Director of Human Resources
shall certify to the City Council that all the requirements of this
chapter have been complied with and completed.

Based upon the operational needs of the Municipal Utilities
Department, OMI/Thames Stockton Water, Inc. employees shall commence
employment with the City of Stockton on the dates determined by the
City Manager, but no later than March 1, 2008.
