Definitions used in this chapter have the following meanings:
"Garage sales"
means general sales open to the public conducted from or on a residential premises, or from a temporarily arranged site elsewhere in the city, for the purpose of disposing of personal property, including, but not limited to, all sales titled "garage, moving, estate, lawn, yard, attic, porch, backyard, patio, or basement sales."
"Personal property"
means property which is utilized, owned and maintained by an individual or by members of a residence and acquired in the normal course of living in or maintaining a residence. It does not include merchandise which was purchased for resale or obtained from closeouts, fire sales or other quantity liquidations, or commercial consignments.

A. 
The city manager or designee shall issue a permit for garage sales upon application if it appears from the applications that the applicant will comply with the terms and provisions of this chapter.
B. 
No person or household shall hold more than two garage sales during one calendar year. A garage sale permit shall be issued for a period not to exceed three consecutive days and the hours of operation shall be between eight a.m. and seven p.m.
C. 
Permits may be obtained from City Hall and will identify the responsible person(s) conducting the sale, address of the sale, dates of the sale, hours of operation and general requirements covered under this chapter.
D. 
Personal property offered for sale may be displayed within the residence, in the garage, carport, and/or yard of the residence and only in such areas. No property offered for sale may be displayed in any public right-of-way, sidewalk, alley or street.

A. 
Signs advertising such garage sales may only be posted on the property of the owner or person in charge of the property upon which the sale will occur.
B. 
There shall be allowed a maximum of two signs, not to exceed four square feet, posted off-premises provided that the signs are not posted on utility poles, regulatory signs or posts, placed on sidewalks or any other public right-of-way. Signs placed on private property must be done with the consent of the owner of such property. Within twenty-four hours of the conclusion of the garage sale, all such advertising signs shall be removed.
C. 
Advertising on radio, TV, newspaper, internet and similar mediums is allowed.

A. 
Owners or persons in charge of property will be presumed to be advised of the existence of the code and violations by such person will authorize enforcement action by appropriate city staff.
B. 
Any person violating any of the provisions of this chapter shall be deemed guilty of a violation and upon conviction of a first offense, shall be fined not less than fifty dollars or more than two hundred fifty dollars, excluding court costs and assessments. Each day that a sale is conducted in violation of this chapter shall constitute a separate offense.
