The cultural arts commission has been created by the city council of the city of Westminster.

The cultural arts commission shall consist of five regular members. Any person over the age of eighteen who meets the city's residency requirements and whose residency is verified may serve on the cultural arts commission. The city council seeks persons who are interested in serving the city and have an interest in culture and the arts throughout the community. Each commissioner should be concerned with improving the quality of life through cultural activities. Commissioners are not selected on the basis of representing a specific organization or cause.

The term of office shall be for two years and shall expire the first day following the regular municipal election. Each city council member shall appoint one cultural arts commission member. These members will serve at the pleasure of the appointing council member.

A. 
The cultural arts commission is advisory to the city council. The following identifies some of the ways the cultural arts commission may carry out its duties and responsibilities.
1. 
Recommend Policy. The adoption of all policy is the prerogative of the city council; however, the cultural arts commission may make recommendations on policies pertaining to arts programs, cultural affairs, the cultural arts center and fund development; and
2. 
Give due attention and study to the arts and cultural affairs and the development of facilities as they affect the people of Westminster; and
3. 
Stimulate community interest in cultural arts (visual and performing); and
4. 
Interpret the cultural needs of the community; and
5. 
Encourage individuals, citizen groups and the business community to donate time, funds, and inkind services for the development and implementation of programs, special events, projects and facilities; and
6. 
Serve as a sounding board to which the city council may test their plans and ideas; and
7. 
To hold at least six meetings per year or at the pleasure of the city council.

A. 
Any prior resolutions having pertained to any previous cultural arts commission that was established is hereby rescinded.
B. 
The commission may establish its meeting dates and times by resolution.

The commission shall elect a chairperson and a vice-chairperson from among its members to office following the initial appointment of the commission members by the mayor and city council members, which normally occurs in January after the municipal election within the city. In the month of January of each year, or at the first meeting thereafter at which the commission convenes, the first order of business on the agenda shall be for the commission to elect a new chair member and vice-chair member. The office of chair member and vice-chair member shall be held for one year, with a maximum of two consecutive terms, with the proviso that a new chair member and/or vice-chair member is willing to serve in that capacity. In the event of the chair member's resignation or removal, the commission is to elect another chair member for the unexpired term. Either officer can be removed by a majority vote of the entire commission.

The community services director shall be the designated staff advisor for the commission and shall provide appropriate assistance.

Willful violation of a decision of this commission by any party to a controversy or dispute shall be deemed a misdemeanor, punishable as provided in this code.
