This chapter may be cited as the "demolition standards for the city of Cannon Beach."

The purpose of this chapter is to establish minimum standards by which demolition of existing structures and their accessory structures greater than two hundred square feet or structures with utility connections is to be conducted. The proposed standards are intended to ensure that the public health, safety and welfare are protected when structures are removed.

For the purposes of this chapter, the following terms, phrases, words, and their derivations shall have the meaning given in this section:
"Demolish"
means to do anything in the removal of a structure, as defined herein, and "demolition" has a corresponding meaning;
"Structures"
means buildings, foundation of buildings, piles, and similar features that are greater than two hundred square feet or have existing utility connections.

A demolition permit is required to demolish a structure. The demolition permit may be conditioned as necessary to mitigate adverse impacts associated with demolition activities and the condition of the vacant site following demolition. All demolition work shall be completed within thirty days from commencement of demolition activity. The building official may grant a permit extension. Final inspection is required to ensure compliance with the standards of this chapter and permit conditions.

Prior to the issuance of a permit to demolish a structure, the permit applicant shall certify the following:
A. 
Electrical Service. The power to all electric service lines has been shut off and all such lines have been disconnected outside the property line or to the source if fed from another structure on the same property. If removal is to outside the property, the serving utility shall be contacted for their removal.
B. 
Gas Service. The property owner or their agent shall notify the gas utility company servicing the site for disconnection and removal of supply lines or storage equipment from the site.
C. 
All water, storm, and sanitary sewers, and other service lines shall be shut off and/or abandoned as required by the public works director or other agency. All service utilities shall be properly capped or terminated at property lines or at the service connection in the right-of-way unless otherwise approved.
D. 
Utilities removal and/or decommissioning of utilities shall be completed in accordance with all applicable laws and procedures.

Unless otherwise approved by the building official, underground and above ground storage tanks and septic tanks shall be removed or decommissioned in place. Property owner or agent shall remove or decommission these tanks in accordance with all applicable laws and procedures. Tank removals or decommissioning shall be completed prior to calling for a final inspection.

Erosion control measures shall comply with best management practices and shall be in place prior to and during any demolition activity. All areas that have been disturbed by demolition activity shall be stabilized to prevent erosion.

Nothing in this chapter shall prevent or delay the demolition of any structure to remedy a condition determined dangerous to the general public as determined by the building official or fire district.
