All dogs and cats shall be kept under restraint.

It shall be unlawful for any owner to fail to exercise proper
care and control over any dog or cat owned or in the custody of such
owner, or to fail to exercise proper care and control over the premises
where any such dog or cat are kept, so as to prevent such animals,
or the conditions of such premises, from becoming a public nuisance.

Each of the following conditions, situations, or occurrences
is hereby declared to be a public nuisance:
(1) Any
animal turning over garbage containers or scattering or spilling garbage,
trash or refuse;
(2) Any
animal damaging private or public property;
(3) Any
dog, livestock, or fowl at large or free-roaming off of private property
owned or controlled by the owner of said dog, livestock, or fowl;
(4) Any
animal barking, whining, or howling in an excessive, continuous, or
untimely fashion, so as to disturb persons of ordinary sensibilities
from the peaceful enjoyment of their property; or
(5) A building,
room, cage, yard, run, or other place or facility where animals are
kept or harbored which is not maintained in a clean and sanitary condition
so as to prevent obnoxious odors, the attraction, breeding, or potential
breeding of flies, the attraction, harboring or breeding of rodents,
or the creation of any other public health hazard.
