There is hereby created and established a permit for the operation
of tow trucks and/or towing businesses located within the city to
the extent permitted in state and federal law.

(a) It
shall be unlawful to operate a tow truck or towing business which
performs tows and has a place of business in the city without a permit.
(b) It
shall be unlawful to operate a tow truck or towing business which
performs nonconsent tows in the city without a permit.

Said permit shall be issued for a term of one year from date
of issuance and there shall be a permit fee to be set by ordinance
and maintained in the schedule of fees in the city secretary's office
for each tow truck proposed to be operated, for the issuance thereof.
Prior to issuance of said permit, the vehicle for which it is issued
shall be inspected by the police chief, at a place and time of his
designation in the city for the purpose of determining that it has
all the equipment required by this article. Upon successful completion
of inspection and submission of a certificate of compliance with the
insurance requirements of this article, a permit will be issued by
the office of the city secretary. Said permit must be renewed each
year in the month of the permit issuance. Each tow truck is further
subject to additional inspections by a designated representative of
the police department during the course of the permit year.

(a) Every
person required to obtain a permit pursuant to this article desiring
to engage in the towing business in the city shall complete an application
for a permit on a form provided by the city secretary, for a permit
to engage in the tow truck business and for a permit for each tow
truck proposed to be operated. The application shall state the name
of owner of the tow truck, name of the business under which the tow
truck is to be operated, address of the owner and operator and the
vehicle identification number. Every application when filed shall
be sworn to by the applicant and accompanied by a permit fee for the
business and each tow truck proposed to be operated, and this fee
shall not be returned to the applicant.
(b) Every
application shall also contain evidence that the applicant is holder
of a license for or has an agreement with the licensed private lot
to deliver motor vehicles to each storage lot listed on the application.

A permit fee to be established by ordinance and maintained in
the schedule of fees which is on file in the city secretary's office
will be charged for each permit.
