As used in this chapter, antique shop means a shop where secondhand merchandise is sold at retail, but where at least 90%, measured according to value, of the used or secondhand merchandise on hand at any time consists of objects of art, bric-a-brac, curios, or household furniture or furnishings, offered for sale upon the basis, express or implied, that the value of the property, whole or in substantial part, is derived from its age or from its historical associations.

The operator of any antique shop may, in lieu of the secondhand dealer's permit required by Section 5.58.020, apply for and obtain a special permit to conduct an antique shop. Such application shall be made to the Business Services Coordinator who shall refer all such applications to the Chief of Police for investigation that such permittee's antique shop is in accordance with the definition set forth in this chapter. Every application hereunder must be accompanied by a permit fee in such amount as is established from time to time by resolution of the City Council. Accompanying the application, such permittee shall pay to the Business Services Coordinator such tax fees as are required for a valid business license issued by the City to cover his or her business activity.

The holder of an antique shop permit is exempt from requirements set forth in Chapter 5.58, except however, that when permittee is buying, in receipt of, handling, disposing or selling serialized secondhand property, precious metals or jewelry, the following provisions shall apply:
A. 
Permittee shall report all serialized secondhand property, precious metals or jewelry which he or she has purchased, taken in trade, taken in pawn, accepted for sale on consignment, or accepted for auctioning to the Chief of Police, not later than 12:00 noon of the day following the acquisition of such property.
B. 
Such reporting, holding and buying of serialized secondhand property, precious metals or jewelry by permittee shall be according to and be in compliance with Sections 5.58.050 through 5.58.110.
