No person shall conduct a circus, carnival, tent show, or similar business enterprise, as defined in Section 5.15.070, except those mentioned in Section 5.14.200, within the City without permission of the City Council to conduct such business enterprise.

No carnival, fair, circus, dog or animal show, or other show or entertainment given in any tent, open enclosure or temporary structure shall be held or conducted within 1,000 feet of any school, schoolhouse, church or other place of public worship, hospital or sanitarium within the City. The provisions of this section shall not apply to meetings of a religious, educational or political character.

Any person desiring to obtain a permit to operate a circus or to be employed at a circus shall make application to the Business Services Coordinator who shall refer all such applications to the Chief of Police for an investigation.

The Chief of Police shall cause each applicant to be fingerprinted and photographed, a record of which shall be kept in the office of the Chief of Police. The applicant shall pay the amount set by the State for processing the fingerprints. The Chief of Police shall cause an investigation of each applicant to be made to determine if such applicant has committed any act that, if done by a permittee, would be grounds for revocation or suspension of a permit, or if such applicant has been convicted of a felony or any crime that has a substantial relationship to the permitted business.

Each application shall be accompanied by a permit fee in such amount as is established from time to time by resolution of the City Council.
