The Placer County board of supervisors, in creating the Placer County children and families commission, is acting to establish its eligibility for funding as of January 1, 1999. In doing so, it is understood that the commission is being created prior to any guidelines being adopted by the California Children and Families Commission and specifically reserves its prerogative to amend any portion of this article.

The board of supervisors of the county of Placer, in order to establish the Placer County children and families commission, finds as follows:
A. 
The voters of the state of California, on November 3, 1998, passed the California Children and Families Program of 1998. The Program recognizes that there is a compelling need in California to create and implement a comprehensive, collaborative, and integrated system of information and services to promote, support, and optimize early childhood development from the prenatal stage to five years of age.
B. 
The Program further recognizes that there is a compelling need in California to ensure that early childhood development programs and services are universally and continuously available for children until the beginning of kindergarten. Proper parenting, nurturing, and health care during these early years will provide the means for California's children to enter school in good health, ready and able to learn, and emotionally well developed.
C. 
It is the intent of this article to facilitate the creation and implementation of an integrated, comprehensive, and collaborative system of information and services to enhance optimal early childhood development. This system should function as a network that promotes access to all information and services from any entry point into the system. It is further the intent of this article to emphasize local decision making, to provide for greater flexibility in designing delivery systems, and to eliminate duplicate administrative systems.
D. 
The California Children and Families Program of 1998 provides for funding through an excise tax on tobacco products in order to implement the goals and objectives which are outlined in the Program itself. It is the further intent of this article to create Placer County's children and families commission and Placer County's children and families trust fund in order to receive funding through the Program and to implement the goals and objectives outlined in the California Children and Families Program of 1998.

"California Children and Families Commission"
(commonly known as First 5 California) means the state commission established in accordance with Health and Safety Code Section 130110.
"Commission"
means the First 5 Placer children and families commission (commonly known as First 5 Placer) established in accordance with Health and Safety Code Section 130140 and this article.
"County strategic plan"
means the plan adopted by the Placer County children and families commission established pursuant to the Program and in accordance with Health and Safety Code Section 130140.
"Program"
means the California Children and Families Program of 1998.
"Trust fund"
means the children and families trust fund account established with the Placer County treasurer for the purpose of receiving and managing Program funds in accordance with Health and Safety Code Section 130105(d)(2)(A).

Pursuant to the provisions of Health and Safety Code Section 130140, there is established in the county a Placer County children and families commission consisting of nine members pursuant to Section 49.70.

Pursuant to California Health and Safety Code Section 130105 there is established a trust fund to be known as the children and families trust fund. The monies allocated and appropriated to the county commission shall be deposited in said trust and shall be expended only for the purposes authorized by this Program and in accordance with the county strategic plan.

The purpose of the commission is to develop, adopt, promote and implement a county strategic plan for local early childhood development programs consistent with the goals and objectives of the California Children and Families Program of 1998 as set forth in Division 108 of the Health and Safety Code, commencing with Section 130100.

The commission shall have all the powers and duties provided by law to accomplish its purpose as particularly set forth in Health and Safety Code Sections 130140, 130140.1(c) and such other duties which are reasonably necessary to discharge their responsibilities under the Program, including the authority to enter into contracts.

The commission shall consist of nine members appointed by the board of supervisors.
A. 
Two members of the commission shall be selected from among the county health officer and those persons responsible for management of county functions pertaining to children's services, public health services, behavioral health services, social services, and tobacco and other substance abuse prevention and treatment services.
B. 
One member of the commission shall be chosen by the board of supervisors from among its members.
C. 
The remaining members of the commission shall be selected from among the persons described in subsection A of this section and persons from the following categories pursuant to Health and Safety Code Section 130140(a)(1)(A): recipients of project services included in the county strategic plan; educators specializing in early childhood development; representatives of a local child care resource or referral agency, or a local child care coordinating group; representatives of a local organization for prevention or early intervention for families at risk; representatives of community-based organizations that have the goal of promoting nurturing and early childhood development; representatives of local school districts; and representatives of local medical, pediatric, or obstetric associations or societies.
D. 
One of the members shall work or reside in the Tahoe region and represent the concerns of that region, as well as satisfying one of the criteria under subsection A, B, or C.

A. 
The commission shall adopt bylaws, which set forth the manner of appointment, selection or removal of the commission members and any alternates, the duration and number of terms members shall serve, and any other matters that the board of supervisors deems necessary or convenient for the conduct of the commission's activities.
B. 
Commissioners serve at the will and pleasure of the board of supervisors, and may be removed from the commission prior to the expiration of the term established by subsection A of this section by a majority vote of the board of supervisors.
C. 
An office shall become vacant if a Commission member resigns, becomes incapacitated, expires, is removed pursuant to subsection B of this section, discontinues to function in the area or office from which appointed, or fails to attend three consecutive meetings of the commission. The board of supervisors may choose to waive the vacancy in favor of the incumbent member of the commission, or choose to make interim appointments to fill unexpired terms occurring during the term of members of the commission. The board of supervisors shall endeavor to fill all vacancies within 90 days.
D. 
The members of the commission shall elect a chairperson bi-annually who shall serve for a two-year term.

Procedures for the conduct of business of the commission not specified in this article shall be contained in bylaws adopted by the commission, which shall be subject to the requirements of the Ralph M. Brown Act.

A. 
The commission shall adopt an adequate and complete county strategic plan for the support and improvement of early childhood development within the county.
1. 
The county strategic plan shall be consistent with and in furtherance of the purposes of the California Children and Families Program of 1998 and any guidelines adopted by the State Children and Families Commission pursuant to subdivision (b) of Health and Safety Code Section 130125 that are in effect at the time the plan is adopted.
2. 
The county strategic plan shall, at a minimum, include the following: a description of the goals and objectives proposed to be attained; a description of the programs, services, and projects proposed to be provided, sponsored, or facilitated; and a description of how measurable outcomes of such programs, services, and projects will be determined by the commission using appropriate reliable indicators. No county strategic plan shall be deemed adequate or complete unless and until the plan describes how programs, services, and projects relating to early childhood development within the county will be integrated into a consumer-oriented and easily accessible system.
B. 
The commission shall conduct at least one public hearing on the proposed county strategic plan before the plan is adopted.
C. 
The commission shall periodically review, on an annual or more frequent basis, the county strategic plan and revise the plan as may be necessary or appropriate. The commission shall conduct at least one public hearing on such periodic reviews of the county strategic plan before any revisions to the plan are adopted.
D. 
The commission shall submit the adopted county strategic plan and any subsequent revisions thereto to the state children and families commission and the board of supervisors.

A. 
The commission shall have prepared and shall adopt an annual audit and report pursuant to Health and Safety Code Section 130150. The commission shall conduct at least one public hearing prior to adopting any annual audit and report.
B. 
The commission shall conduct at least one public hearing on each annual report by the state children and families commission prepared pursuant to subdivision (b) of Health and Safety Code Section 130150.
