The board finds that in certain areas of the county, parking impinges upon the need of residents to use a reasonable amount of parking space in front of or near their own homes. This part is adopted in order to allow a reasonable accommodation between the needs of non-residents and the needs of county residents for parking spaces. In addition, where non-resident parking is disruptive to a neighborhood, or appropriate parking availability does not meet standards as determined by the county, this part may be applied.
The terms used in this part shall have the following definitions:
"Dwelling unit"
shall mean a self-contained residential house, apartment, stock cooperative unit, or condominium unit occupied by a single household exclusively for residential purposes.
"Eligible driver"
means a licensed driver identified as the registered owner of a currently registered vehicle who resides in a dwelling unit within a residential permit parking zone.
"Guest permit"
means a temporary parking permit issued to a resident pursuant to this part or an ordinance enacted pursuant to the authority granted herein, for use by a person visiting a residence in a residential permit parking zone or for workers providing services such as caregiving, gardening, repair maintenance and construction to the resident, which shall exempt the guest's vehicle from parking time restrictions established pursuant to this part.
"Non-resident vehicle"
means a motor vehicle operated by a person whose destination is not to a residence within a residential permit parking zone or otherwise not eligible to be issued a residential parking permit, pursuant to the terms and conditions of this part, for the specific area in which it is parked.
"Resident"
shall mean a person living in a dwelling unit in a residential permit parking zone.
"Residential permit parking zone"
means any contiguous area upon which the board imposes parking limitations pursuant to the authority granted by this part.

By ordinance or resolution, the board may establish certain permit parking zones on streets within the county where persons occupying residences with frontage on such streets may be permitted exemptions from the posted general restrictions of parking. The director of public works or designee shall cause the erection of signs indicating the area so established once the ordinance or resolution designating a residential permit parking zone has been adopted and after at least 60% of the households have purchased permits. There shall be two alternative processes by which the board can consider any such area for designation as a residential permit parking zone identified in the following subsections A and B:
A. 
Initiation by Residents. The board shall consider for designation as a residential permit parking zone any such proposed area for which a petition has been submitted that meets and satisfies the following requirements and any administrative guidelines adopted by the board:
1. 
A petition signed by a majority (51% or greater) of dwelling units is required to initiate the process for consideration for designation as a residential permit parking zone.
2. 
Only one vote per dwelling unit will be considered for a petition.
a. 
For petitions involving rental complexes, the residents, property managers, and property owners will participate in the petition survey.
b. 
If the units in a multifamily property are individually owned, each owner would be included in the petitioning process.
B. 
Initiation by Board or Director of Public Works or Designee. The board or director of public works or designee shall initiate the process for consideration for designation as a residential permit parking zone a location that satisfies all of the following requirements and any administrative guidelines adopted by the board:
1. 
That non-resident vehicles do, or may, substantially interfere with the use of on-street or alley parking spaces adjacent to neighborhood residences;
2. 
That the interference by the non-resident vehicles occurs at regular and frequent intervals during the peak parking demand periods;
3. 
That the non-resident vehicles parked in the area of the proposed residential permit parking zone create traffic congestion, noise, or other disruption (including shortage of parking spaces for residents and their visitors) that negatively impacts the quality of life of the neighborhood; and
4. 
Other alternative parking management strategies are not feasible or practical.
C. 
Upon receipt of a valid resident's (majority) petition for a residential permit parking zone or upon initiation by board or director of public works or designee as described above, the department of public works shall do the following:
1. 
A notice of intent to establish residential permit parking restrictions shall be sent to all dwelling units within the proposed residential permit parking zone;
2. 
Conduct or cause to be conducted a parking occupancy survey to determine the utilization of on-street parking, by which a 70% parking occupancy threshold of all available on-street parking and visible off-street parking is required for further consideration. Occupancy rate refers to the percentage of vehicles that occupy a permit parking zone based on the known parking inventory;
3. 
Present to the board for action a resolution that would establish a residential permit parking zone in accordance with requirements of this part, including all regulations and time restrictions determined by the board to be reasonable and necessary for such area.
Once the board has taken action on such a resolution to establish a residential permit parking zone, no further changes or requests for changes to residential permit parking restrictions for this area will be considered for a minimum period of one year.
D. 
The director of public works or designee may restrict all or certain portions of county-maintained roadways as residential permit parking only when authorized signs have been posted giving notice of such residential permit parking restrictions. It is unlawful and an infraction for any person to park or leave standing a vehicle within such area during the times and days when such parking is prohibited, other than a vehicle that has been issued a valid residential parking permit or exempted pursuant to this part.
E. 
The board may, by resolution, modify a designated residential permit parking zone in any manner consistent with this part.

A. 
A residential permit parking zone may be revoked by board resolution after following the same procedures for establishing a residential permit parking zone as set forth in Section 10.12.220.
B. 
If 60% of the households in a residential permit parking zone fail to purchase permits after being duly noticed, the director of public works or designee may revoke the residential permit parking zone upon notice to the residents without further action of the board of supervisors.

A certain quantity of such permits shall be available to each residence having frontage in the posted area. The director of public works may adopt reasonable rules to implement the program.
A. 
If an existing placard system is in effect, the program shall maintain its current policies with the intention to transition to a virtual permit system.
B. 
If a virtual permit system is available, the program will utilize the following criteria:
1. 
Duration. A parking permit shall be issued with a term not to exceed one year from the date of issuance, unless earlier revoked or terminated, provided however that a permit shall automatically terminate when the permit holder ceases to reside in the designated residential permit parking zone.
2. 
Eligibility. A residential parking permit may be issued only to an eligible driver who can demonstrate that they currently reside at an eligible dwelling unit within the residential permit parking zone for which the permit is to be issued. Persons may apply for residential parking permits per guidelines established by the department of public works. To be issued a residential parking permit, each eligible driver shall provide the following information:
a. 
The applicant's full, true name and home address, and proof of residence;
b. 
The applicant's driver license;
c. 
A valid and current vehicle registration and license plate number of the vehicle for which a permit is being requested;
d. 
The applicable fee of residential parking permits, guest parking permits, or any other parking permit based on the current parking fee schedule established by resolution by the board and charged at the time of permit issuance and/or renewal. The board may change fees at any time by ordinance or resolution; and
e. 
Other information as required by the director of public works or designee.
C. 
The board may, by resolution, limit the number of permits issued to any resident, dwelling unit, or residential permit parking zone if such limitation would further the purposes of the residential permit parking program.

A. 
The board may, by resolution, authorize the issuance of temporary guest parking permits in any residential permit parking zone. When authorized, a resident within a residential permit parking zone may apply for temporary parking permits for use by their guests in the residential permit parking zone where the resident resides.
B. 
Guest permits may be issued under the following conditions:
1. 
The resident applicant for a guest parking permit has not reached the limits, if any, set by the board.
2. 
Such other conditions and restrictions that the board by resolution imposes or that the director of public works or designee deems appropriate.
C. 
Use of guest parking permits shall comply with residential permit parking regulations established pursuant to this part to be valid within the residential permit parking zone for which it was assigned.
1. 
Intentional or repeated misuse of guest parking permits by a resident or their guests may be cause for revocation of the resident's guest parking permit privileges.
D. 
A guest parking permit shall be valid for a prescribed period of time, commencing upon the date authorized, and shall exempt the applicable vehicle from parking time restrictions established pursuant to this part.

The director of public works or designee may, at their discretion, issue additional residential parking permits to persons occupying residences with frontage on streets within a permit parking zone in cases of special circumstance or hardship.

The residential parking permits shall allow for the parking of four-wheel passenger vehicles in residential permit parking zones only. Recreational vehicles and non-motorized vehicles (i.e., trailers) are not included in the definition of "four-wheel passenger vehicles" and shall not be parked in permit parking zones. No commercial vehicles shall be parked in these zones except when making pickups or deliveries of goods, wares, or merchandise from or to a building or structure located on the restricted street, or when delivering materials to be used in the repair, alteration, remodeling, or reconstruction of a building or structure located on the restricted street for which a building permit has previously been obtained.

A. 
Vehicles lawfully approved for valid permit parking issued pursuant to this article shall be exempt from the provisions related to limitations on parking, if the vehicle is parked within the permit parking zone to which the permit is issued. Any vehicle that has not been issued a valid parking permit shall be subject to the residential permit parking regulations and consequent penalties in effect for such area.
B. 
Nothing in this part shall be construed as permitting any person to park a vehicle in violation of any other restriction on parking.
C. 
Vehicles displaying disabled person or disabled veteran license plate or placard, as described in Vehicle Code Section 22511.5(a)(1), shall be exempt from the provisions of this article.
D. 
A residential parking permit or any other permit as designated by the board shall not guarantee or reserve to the holder thereof any parking space within the residential permit parking zone for which the permit was issued.
E. 
Residential permit parking restrictions shall not apply to police vehicles, authorized emergency vehicles, or county-owned vehicles when used for official business.

No person shall stop, stand or park a vehicle in a permit parking zone during hours when permit restrictions are in effect unless the vehicle is associated with a valid residential parking permit or guest parking permit issued pursuant to this part. Any vehicle found in violation of this provision shall be punishable by a fine as established in the current fine schedule and/or revocation of any permit currently held in consideration of future permit applications. Violations of this part shall include the following:
1. 
Falsely representing oneself as eligible for a residential parking permit or furnishing false information in a residential parking permit application.
2. 
Using a residential parking permit issued pursuant to this part for any motor vehicle other than that for which the permit was issued.
3. 
Copying, reproducing, or otherwise bringing into existence a counterfeit residential parking permit or permits without written authorization from the director of public works or designee.
4. 
Knowingly using or displaying a facsimile or counterfeit parking permit in order to evade time limitations on parking applicable in a residential permit parking zone.
5. 
Selling, transferring or exchanging, or offering to sell, transfer, or exchange, a residential parking permit or permits with any other person, or any other vehicle, except as provided for in this part and without written authorization from the director of public works or designee.
6. 
Knowingly committing any act that is prohibited by the terms of this part or any ordinance or resolution enacted by authority granted by this part.

The board and the director of public works or designee may adopt policies and/or administrative regulations to implement this part, including, but not limited to, the establishment of a residential permit parking zone and the criteria for the issuance, denial, revocation, duration and/or number of permits per household, consistent with the authority granted by this part.
