Following an initial study and a finding that an EIR must be prepared, the CEQA administrator shall cause a draft EIR to be prepared and provide for its public review as provided in this chapter.

A. 
Immediately following a decision that an environmental impact report is to be prepared the CEQA administrator shall send a notice of preparation (CEQA guidelines Appendix J) to each responsible agency and each trustee or federal agency involved or affected by the project.
B. 
Notice of preparation shall be sent by registered mail or other method which provides a record of its receipt and shall include a copy of the initial study.
C. 
Notice of preparation may also be sent to other persons or organizations known to have a concern with the environmental effects of the project.
D. 
Failure of a responsible agency to respond to the notice within thirty days of their receipt of the notice or to request additional time shall allow a presumption that no response will be made.

The draft EIR shall be prepared directly by or under contract to the city pursuant to CEQA guidelines Section 15084. The EIR shall be an informational document containing the information required by Article 9 of CEQA guidelines with attention being given to the considerations contained in Article 10 of CEQA guidelines. The EIR may be any one of the type described in Article 11 of CEQA guidelines and in addition the city may choose to use a previously prepared EIR which adequately analyzes the project at hand pursuant to CEQA guidelines Section 15063.

Prior to publication and circulation of the draft EIR an administrative draft EIR shall be reviewed by the CEQA administrator who will, when such is the case, certify the draft EIR as being complete.

Following completion of the draft EIR a notice of completion (CEQA guidelines Appendix C) shall be filed with the office of Planning and Research pursuant to CEQA guidelines Section 15085).

Following completion of the draft EIR, copies shall be forwarded to all public agencies affected by the project and/or any person, or any organization having special expertise or interest in the project with a request for comments pursuant to CEQA guidelines Section 15086.

Following completion of the draft EIR, public notice of its availability shall be given and the draft EIR shall be circulated pursuant to CEQA guidelines Section 15087. At the discretion of the city a public hearing on an EIR may be conducted either separately or in conjunction with any other hearing to be held on the project.

The review period for a draft EIR shall normally be not less than thirty days (forty-five days if a state agency is involved) and not more than ninety days.

Prior to approving a project, the draft EIR shall be presented to the approving body for their review and certification that the EIR has been completed in compliance with CEQA and that the information contained therein was considered prior to project approval pursuant to CEQA guidelines Section 15090.

Following project approval the CEQA administrator shall file a notice of determination (CEQA guidelines Appendix D) with the Contra Costa county clerk and, if discretionary approval from a state agency is required, with the State Office of Planning Research.

An EIR for a private project shall be completed and certified within one year from the date the project application was certified as complete except that the city may suspend the running of the time period or disapprove the project in the event of unreasonable delay by the project sponsor in meeting requests by the city pursuant to CEQA guidelines Section 15108.
