"City approved plan"
means any plan approved by the City Engineer or authorized representative with signed concurrence of the City Landscape Architect or any plan approved by the City Council or City Landscape Architect.
"Effective removal (tree)"
means any technique, operation, or activity that could lead to the permanent disfigurement, destruction, or the removal (as determined by the Director) of a tree, including any extreme pruning which is not consistent with standard Arboriculture practices.
"Public place"
means any property that is owned, leased, or controlled by the City of Stockton, except rights-of-way and parks.
"Street tree"
means a tree planted by the City, or by another party that has been permitted by the Director to plant in lieu of the City, either in the public right-of-way or public utility easement.

The City of Stockton shall have supervision, direction and control of the planting, setting out, location, placement, care, trimming, removal, relocation and replacement of all street trees and trees and shrubs in parks and other public places owned or controlled by the City of Stockton. Property owners may maintain street trees adjacent to their property in compliance with Chapter 16.72 of the Stockton Municipal Code.

It is unlawful for any person, including any utility company operating under a franchise granted by the City of Stockton, to plant, remove or effectively remove, replace or relocate any street tree without first obtaining a permit therefor from the Community Development Director or a designated representative in compliance with Chapter 16.162 of the Stockton Municipal Code.

No person shall interfere with the City of Stockton while engaged in planting, mulching, pruning, trimming, spraying, treating or removing any street tree or any tree, shrub, or other landscaping in a park or other public place.

No person shall allow, cause, authorize or procure any brine, oil, liquid or other substance, deleterious to the life of any tree, to lie, leak, pour, flow or drip upon or into the soil around the base of any street tree or any tree, shrub, or other landscaping in any park or other public place, or onto any sidewalk, road, pavement or other improvement, within a street right-of-way, public utility easement adjacent to street right-of-way, park or other public place owned or controlled by the City of Stockton, at a point from which such substances may, by lying upon or by flowing, dripping or seeping into such soil, injure any such tree or shrub.

During the erection, repair or alteration of any building or structure, any street tree or tree or shrub in any park or other public place owned or controlled by the City of Stockton, in the vicinity of such building or structure, shall be provided with adequate protection so as to prevent injury or damage thereto, while any such construction work is being performed.
