"Director,"
as used in this chapter, means the Director of Engineering of the City of Santee and any subsequent title for this department head, the City Engineer, or designee. In the event that this position is vacant or eliminated by the City, the Director shall be the City Manager or designee.
"Parade,"
as used in this chapter, means any march, procession or assembly consisting of persons, animals or vehicles, or combination thereof, upon any street, sidewalk or alley which does not comply with normal and usual traffic regulations or controls.
"Special event,"
as used in this chapter, means any celebration, festival, fair, carnival or similar local special event which is held wholly or partially within a street, the participants in which do not comply with the normal or usual traffic regulations or controls.

It is unlawful for any person to conduct or manage a parade or special event without a written license from the Director or the City Council.

A. 
The Director may issue licenses in accordance with this chapter.
B. 
Upon appeal from a decision of the Director, the City Council may issue a license in accordance with this chapter.
C. 
Any such license may be issued subject to such reasonable conditions as the Director or the City Council may prescribe.
D. 
The Director must not, without the approval of the City Council, issue a license for a parade or a special event which requires the temporary closing of a portion of a street for more than 24 hours.

Any person desiring to conduct or manage a parade or special event must, not fewer than 30 nor more than 180 days before the date on which it is proposed to conduct such parade or special event, file with the Director an application for a license for such parade or special event; provided the Director may accept and act on any application filed fewer than 30 days before such parade or event. The application must be in the form and contain the information required by the Director.

No license for a special event may be issued unless the Director or the City Council determines that the special event is primarily for the benefit of the community and that the use of the street for such purpose is in the public interest.

No license may be issued authorizing the conduct of a parade or special event which the Director determines:
A. 
Is to be held for the sole purpose of advertising any product, goods, wares, merchandise or event and is designed to be held purely for private profit;
B. 
Is likely to cause injury to persons or property;
C. 
Will unduly interfere with the movement of traffic along or across its route or the movement of firefighting equipment or ambulances to a fire or emergency; or
D. 
Will require unreasonable extraordinary police service.

In the event the Director denies a license or imposes conditions considered unreasonable by the applicant, the applicant may appeal to the City Council who may then consider the application and issue or deny the license.

It is unlawful for any person, without the consent of the licensee, to join or participate in a parade or special event, or in any manner interfere with its progress or orderly conduct.

The Director may temporarily close a portion of a street for a parade or special event for which a license has been issued pursuant to this chapter when in the Director's opinion such closing is necessary for the safety and protection of persons using that portion of the street during the temporary closing. No such closing shall be for more than 24 hours without the approval of the City Council.
