"Swimming pool" means a tank or pool created by artificial means designed for the purpose of containing an outside body of water and offering the possibility of use for swimming, bathing or total bodily immersion by any person, any portion of which tank or pool exceeds thirty-six inches in depth and which pool or tank may or may not be portable in design or construction.

Every person in possession of land within the city, either as owner, purchaser under contract, lessee, tenant, licensee or otherwise upon which is situated a swimming pool, shall at all times maintain on the lot or premises upon which such pool is located and completely surrounding such pool, lot or premises, a fence or other solid structure not less than five feet in height with no opening therein, other than doors or gates, larger than six inches square. Such enclosure shall be maintained in good repair at all times.
All gates or doors opening through such enclosure shall be equipped with a self-closing and self-latching device designed to keep and capable of keeping such door or gate securely closed at all times when not in actual use, and which self-latching device shall not be located at nor accessible from less than four feet six inches above grade; provided, however, that the door of any dwelling occupied by human beings and forming any part of the enclosure required in this section need not be so equipped. Driveway gates shall not be deemed to constitute part of the required enclosure.

It is a nuisance and unlawful for any person to keep in the city, or suffer or permit to be kept at or upon any premises in the city-owned, controlled or occupied by him or her, a swimming pool, spa or hot tub in a foul, noxious, filthy or stagnant condition. The water of all swimming pools, spas and hot tubs must be kept sufficiently clear that the bottom will be visible at all times.
