As used in this chapter:
Construction or repair
each mean and include the transportation or delivery of any materials, tools or equipment to or from the site of any construction project, or the unloading or use of such materials, tools or equipment at such site.
Public holiday
means the following holidays:
(a) 
New Years Day (January 1st)
(b) 
Memorial Day (the fourth Monday in May)
(c) 
Independence Day (July 4th)
(d) 
Labor Day (the first Monday in September)
(e) 
Thanksgiving (the fourth Thursday in November)
(f) 
Christmas (December 25th)

It is unlawful for any person within a residential zone, or within a radius of 500 feet therefrom to do any of the following:
(a) 
To operate equipment or perform any outside construction or repair work on any building, structure, project, or to use any pneumatic hammer, steam or electric hoist, backhoe, bulldozer or dump truck or other construction type device, between the hours of 5:30 p.m. of one day and 8:00 a.m. of the next succeeding day on any Monday through Saturday, or at any time on any Sunday, or at any time on any public holiday; or
(b) 
To use any pneumatic hammer, steam or electric hoist, backhoe, bulldozer or dump truck or other construction type device, at any time on any Saturday, unless beforehand a permit therefor has been obtained in accordance with the provisions of this chapter.
Nothing contained in this chapter shall prohibit the operation of any equipment other than that prohibited in subsection (b) of this section, or the performance of any outside construction or repair work on any building, structure or project between the hours of 8:00 a.m. and 5:30 p.m. No permit shall be required to perform emergency work in the event of an emergency which imperils the public safety. This section shall not apply to the use of domestic power tools as specified in Section 5-6.03.

A homeowner who individually undertakes, to maintain or improve his or her property and or residence may operate or permit the operation of domestic power tools, such as, any mechanically powered saw, sander, drill, grinder, lawn or garden tool, or similar tool between the hours of 8:00 a.m. and sunset on any Monday through Friday or between 9:00 a.m. and sunset on any Saturday and Sunday. Provided that any such operation is limited to the improvements or maintenance undertaken by the homeowner him or herself.

A permit may be issued authorizing work prohibited by Section 5-6.02 whenever it is found that the public interest will be served thereby. An application for a permit shall be in writing, shall be accompanied by an application fee in an amount to be set by resolution of the City Council, and shall set forth in detail the facts showing that the public interest will be served by the issuance of the permit.
Applications shall be made to the Director of Public Works who shall be responsible for the administration and enforcement of this section and shall have the authority to issue such permits.

Any person violating any of the provisions of this chapter shall be deemed guilty of an infraction. Any person convicted of an infraction under the provisions of this chapter shall be punishable by a fine as stipulated under Section 1-2.06 of this Code. Violations of this chapter shall also be deemed a public nuisance.
