The Public Works Manager is directed to establish a calendar system whereby each of the roadways is inspected quarterly by the Public Works Department of the Township of Pittsgrove and assessed, with maintenance to be provided on an as-needed basis in such a manner as is practicable given other demands as to the Township.
In the event residents have issues relating to the roadways, the Public Works Supervisor shall attempt to address concerns raised within the confines of budgetary, equipment, personnel and access-related restraints. This chapter is prepared for the purpose of enabling those making use of the unimproved roads within the Township to have an expectation that their roadway will be treated similarly to all other similar roadways in the Township; however, this chapter is not considered on the basis of any survey or title work showing cartway widths, turnarounds or ownership information. In the event a claim is brought by any party seeking to bar the Township from access to a roadway, such claim shall be dealt with on a case-by-case basis in consultation with the Township Solicitor insofar as this chapter is not in any way meant to serve as an acceptance of dedication of a roadway or claim of ownership of any roadway. Moreover, no maintenance provided hereunder is intended to further obligate the Township as to any future roadway improvements or maintenance issues in the future.
Notwithstanding language which could be construed to the contrary herein, the Township of Pittsgrove in consultation with its Solicitor and in contemplation of this chapter seeking to set about a means by which those making use of unimproved roadways within the Township may anticipate their roadway being treated similarly to any other similarly situated roadway, the Township does specifically reserve any and all arguments available to it by way of law deriving from the Township of White v. Castle Ridge Development Corporation (Warren County, Superior Court Appellate Division, March 11, 2011, and the case law and statutes relating to same) relating to the rights of the Township.
