Pursuant to the Parking and Business Improvements Area Law of 1979 (California Street and Highways Code Section 36500 et seq.), there is hereby established a business improvement area within the city to be known as "business improvement area No. 1." The boundaries of business improvement area No. 1 are as shown in Resolution No. 8960, on file in the office of the city clerk. Businesses lying within business improvement area No. 1 shall be subject to any amendments to the aforesaid Parking and Business Improvement Area Law of 1979 which may be enacted after the effective date of the ordinance codified in this chapter.

All businesses within business improvement area No. 1, except those exempt by law, are subject to the charges and assessments imposed by this chapter, which are in addition to the business license taxes required by Chapters 5.04 through 5.12 of this code.

Charges and computations imposed by this chapter shall be set by city council resolution.

Assessments shall be expended for only those purposes set forth in the Parking and Business Improvements Area Law of 1989 (California Street and Highways Code statute 36500 et seq.), and any amendments to the aforesaid Parking and Business Improvement Area Law of 1989 which may be enacted hereafter.

Charges and assessment imposed by this chapter shall be paid in accordance with the provisions of Chapters 5.04 through 5.12 of this code in the same manner and at the same time as annual business license fees.

No person shall fail or refuse to pay any charges or assessments imposed by this chapter, and all civil and criminal penalties, including interest penalties, provided for in Chapters 5.04 through 5.12 of this code, shall apply.

Any business which is exempt from the payment of the charges or assessments imposed by this chapter by reason of the provisions of the Constitution of the United States or of this state, or the place of business of which is outside of business improvement area No. 1, may make a voluntary contribution to the fund established by this chapter for the purposes provided for in this chapter.

There is created a special fund designated as "business improvement area No. 1 fund," into which all revenues derived from charges, assessments, and contributions under this chapter, less the cost of collection, shall be placed and such funds shall be used only for the purposes specified in Section 5.82.080.

The city council may annually approve a budget to include an estimate of expenditures to be made from the business improvement area No. 1 fund to carry out the purposes of this chapter.
