The Board shall cause minutes of the hearing to be made and
shall append thereto all reports, written communications, exhibits
and petitions received during or prior to such hearing. Such minutes
shall be available for public inspection in the office of the Board
upon their approval by the Board.
An application may be administratively withdrawn without prejudice
as of right before notice has been sent to the newspaper for publication
or by mail to affected persons. After notice has been sent, withdrawal
of an application will be allowed without prejudice by vote of the
Board unless doing so would adversely affect a party other than the
applicant or would impede the Board from carrying out its duties.
Once a petition has been voted upon and the meeting adjourned,
there shall be no reconsideration of a decision of the Board.
Any changes made to any approved project shall require prior
written approval. The Board's policy is that revisions to any
approved plans or Board decisions shall be as follows:
A. Designating revisions to a decision, any of the conditions of approval,
or project changes as minor revisions shall require a majority vote
of the Board at a public meeting. Minor modifications shall be limited
to changes that do not have a material impact on the project, and
do not grant any zoning relief not originally requested or approved
during the public hearing. Minor modifications shall be consistent
with the purpose and intent of the Zoning Bylaw.
B. Approval of the minor modifications shall require a vote of four
members of the Board.
C. Major revisions resulting in substantial change on the impact of
the development on municipal services or abutters shall require a
new public hearing for a formal amendment to the original approval,
pursuant to MGL c. 40A, §§ 9 and 11.
D. Field changes are minor adjustments made in the field based on actual
conditions encountered during construction, such as shifting the location
of a pipe or catch basin or substituting like in-kind materials. Field
changes shall be permitted with written approval from the Zoning Administrator
or Building Commission.
