With the exception of Section 15.200 relating to civil parking penalties and late payment fees, and except as hereinafter may be provided, Title 15 of the Los Angeles County Code, as amended from time to time, regulating vehicles and traffic, is hereby adopted and shall be and become the Traffic Code of the city of La Cañada Flintridge. A parking citation bail schedule, as authorized pursuant to Section 40203.5(a) of the California Vehicle Code, shall be adopted by city council resolution.

A. 
A vehicle transporting a hazardous material or substance as identified in Title 49 of the Code of Federal Regulations must be attended at all times by its driver or a qualified representative of the motor carrier that operates it, and shall not be parked on any highway, highway shoulder, street, alley, public way or public place, or within five feet of the traveled portion thereof, within a residential zone or within 1,000 feet of any school or within 300 feet of any bridge or tunnel, except for brief periods when mechanical or equipment failure or disablement or malfunction of the vehicle, or the necessities of operation require the vehicle to be parked and make it impractical to park the vehicle in any other place.
B. 
Repair, maintenance, refuse, utility, termite and pesticide vehicles, fuel delivery vehicles, and vehicles delivering life support and health commodities, while servicing residential areas or schools, are exempt from the provisions of subsection A of this section. Additionally, such exempt vehicles need not be attended while the drivers are performing duties that are evident and necessary as the operator of the vehicle or the provider of the service.
C. 
For purposes of this section:
1. 
A motor vehicle is attended when the person in charge of the vehicle is on the vehicle, awake, and not in a sleeper berth, or is within 100 feet of the vehicle and has it within his or her unobstructed field of view.
2. 
A qualified representative of a motor carrier is a person who:
a. 
Has been designated by the carrier to attend the vehicle;
b. 
Is aware of the nature of the hazardous material or substance contained in the vehicle he or she attends;
c. 
Has been instructed on the procedures he or she must follow in emergencies concerning hazardous materials or substances.
D. 
The rules of this section do not relieve a driver from any obligation imposed by federal, state or local laws relating to the transportation of hazardous materials or explosives, motor carrier safety regulations or the placement of warning signs or devices when a motor vehicle is stopped on a public street or highway.

All speeds identified above with an asterisk (*) have been lowered five miles per hour from the nearest 5 mph increment of the 85th-percentile speed based on findings made by the registered engineer that conditions exist on the roadway, not readily apparent to drivers, that warrant such a reduction in the prima facie speed. Specific findings for each street segment are identified in "2019 Engineering and Traffic Survey to Establish Speed Limits" report, 23 April 2019, containing the findings and determinations of the registered engineer, incorporated herein and on file in the office of the city clerk.

A. 
The city manager is authorized to designate specific parking spaces on the street and in off-street parking facilities owned or operated by the city as reserved for the exclusive use of vehicles which display a distinguishing license plate or placard issued pursuant to Vehicle Code Section 22511.5 or 22511.9.
B. 
Any person in lawful possession of an off-street parking facility may designate stalls or places in such facility for the exclusive use of vehicles which display a distinguishing license plate or placard issued pursuant to Vehicle Code Section 22511.5 or 22511.9.
C. 
The designation of stalls or spaces pursuant to subsections A or B of this section shall be performed in the manner required by Vehicle Code Sections 22511.7 and 22511.8.
D. 
Any stall or space designated pursuant to subsection C of this section shall be deemed designated for physically handicapped persons pursuant to Vehicle Code Sections 22511.7 and 22511.8 for all purposes of the traffic code of the city, and of Vehicle Code Sections 22507.8, 22511.7, 22511.8, 22652 and 22652.5.

The city manager and/or designee is authorized, subject to the provisions and limitations of this title, to install and/or remove parking restriction signage and/or the following curb markings so as to indicate parking or standing regulations. The curb markings shall have the meanings as herein set forth:
A. 
Red Curb. No stopping, standing or parking at any time except as permitted by the vehicle code, and except that a bus may stop in a red zone marked or signed as a bus zone.
B. 
Yellow Curb. No stopping, standing or parking at any time between seven a.m. and six p.m. of any day except Sundays and holidays for any purpose other than the loading or unloading of passengers or materials, provided that the loading or unloading of passengers shall not consume more than three minutes nor the loading or unloading of materials more than 20 minutes.
C. 
White Curb. No stopping, standing or parking for any purpose other than loading or unloading of passengers or for the purpose of depositing mail in an adjacent mail box, which shall not exceed three minutes. Such restrictions shall apply between seven a.m. and six p.m. of any day except Sundays and holidays.
D. 
Green Curb. Time limit parking, as applicable, between the hours of seven a.m. and six p.m. on any day except Sundays and holidays. Parking time-limitations shall be appropriately posted and/or marked for specific locations for any duration of period up to, but not exceeding, 30 minutes as determined by the city manager and/or designee.
E. 
Blue Curb. No stopping, standing or parking by any person, other than a handicapped person whose vehicle displays a distinguishing license plate or placard issued pursuant to Section 22511.5 of the Vehicle Code of the state of California.

The city manager and/or designee shall be authorized to install or remove parking restriction signage and/or curb markings upon any property contained within the public right-of-way, subject to the following provisions and limitations:
A. 
The city manager and/or designee must determine that parking restriction signage and/or curb markings shall be installed or removed for the purpose of alleviating traffic, traffic flow, congestion and/or hazards detrimental to the public's health, safety and/or welfare.
B. 
No installation, removal and/or changes in any parking restriction, signage and/or curb markings shall occur without the specific recommendation of the city's traffic engineer.
C. 
Any parking restriction signage and/or curb marking or curb marking removal activity shall be subject to the review and approval of the traffic and public works commission.
D. 
Nothing in this section shall be construed to preclude the right of individuals to appeal to the city council the decision of the city manager and/or designee to install or remove parking restriction signage and/or curb markings.

The county of Los Angeles fire department acting as the fire department of the city of La Cañada Flintridge is authorized to designate fire lanes on any highway, at any curb or in any location in a publicly or privately owned or operated off-street parking facility. The city manager shall post signs or otherwise mark such fire lanes in the manner required by Vehicle Code Section 22500.1. Any place so designated shall be deemed a fire lane for all purposes of the traffic code of the city and of Vehicle Code Section 22500.1.

If the city council, by ordinance or resolution, finds and determines that there are privately owned and maintained roads, as described in said ordinance or resolution, within the city that are generally held open for use of the public for purposes of vehicular travel and which so connect with highways that the public cannot determine that such roads are not highways, then upon enactment of said ordinance or resolution, as authorized by Section 21107.5 of the California Vehicle Code, the provisions of the California Vehicle Code as designated below, shall be applicable on such privately owned and maintained roads.

If the city council finds and determines that a privately owned and maintained road(s) is (are) not generally held open for use of the public for purposes of vehicular travel but by reason of its (their) proximity to, or connection with, public streets or highways, the interest of residents residing along such road(s) and the motoring public will best be served by application of the provisions of the Vehicle Code of the state of California, and the ordinances and resolutions of the city, then the city, may by resolution, as authorized by Section 21107.7 of the California Vehicle Code, designate private streets which are subject to the provisions of the Vehicle Code.

A. 
Notwithstanding Section 3203 of Los Angeles County Ordinance No. 6544, and except as otherwise set forth in this section, no person may park or stand a vehicle on any of the following streets between the hours of two a.m. and five a.m. of any one day:
1. 
Foothill Boulevard;
2. 
Angeles Crest Highway between Foothill Boulevard and the northerly city boundary;
3. 
Any street or portion of a street located in a commercial/office district as designated on the city's general plan land use map.
B. 
The city manager may issue a permit for overnight parking on one or more of the streets set forth in subsection A of this section to any resident and/or disabled person who proves to the satisfaction of the city manager that such parking is required for the health, safety or welfare of such person. For purposes of this section, a disabled person shall be defined as set forth in Section 22511.5 of the California Vehicle Code.

A. 
Commercial Vehicle Parking Restrictions in Residential Districts Between Two a.m. and Six a.m. A person shall not park any commercial vehicle weighing more than 6,000 pounds unladen on any highway or alley between two a.m. and six a.m. of any one day in a residential district. As used herein, the term "residential district" includes any residential zone as defined in the zoning code of the city. It is not a violation of this section to park such vehicles in residential districts when such vehicles are involved in:
1. 
Necessary loading and unloading;
2. 
The actual performance of a commercial service or activity on the adjacent lot or parcel of land;
3. 
Making pick-ups or deliveries of goods, wares, and merchandise from or to any building or structure located on the restricted streets or highways or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon the restricted streets or highways for which a building permit has previously been obtained; or
4. 
The construction or maintenance of a highway or alley.
B. 
Commercial Vehicle Parking Restrictions at Any Time. A person shall not park any commercial vehicle having a manufacturer's gross vehicle weight rating of 10,000 pounds unladen or more on any highway or alley in a residential district. As used herein, the term "residential district" includes any residential zone as defined in the zoning code of the city. It is not a violation of this section to park such vehicles in residential districts when such vehicles are involved in:
1. 
Necessary loading and unloading;
2. 
The actual performance of a commercial service or activity on the adjacent lot or parcel of land;
3. 
Making pick-ups or deliveries of goods, wares, and merchandise from or to any building or structure located on the restricted streets or highways or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon the restricted streets or highways for which a building permit has previously been obtained; or
4. 
The construction or maintenance of a highway or alley.
C. 
Commercial Vehicle Parking Restrictions Between Ten p.m. and Six a.m. Whenever the city council finds, by resolution, that the parking of commercial vehicles on certain public streets or alleys is creating a public nuisance or safety hazard, the director of public works shall erect and maintain adequate signs along such public streets and alleys specifying that a person shall not park any commercial vehicle weighing more than 6,000 pounds unladen between the hours of ten p.m. and six a.m. of the following day.
D. 
Violations and Penalties. Any person who violates any of the provisions of this section shall be guilty of an infraction, punishable by a fine established by resolution.

Any private property may be posted with one or more signs indicating the conditions under which the express or implied consent to park has been given by the owner or person in lawful possession of the property. Such conditions may limit parking to owners, tenants, customers, patrons, members or guests and may limit parking for fixed periods of time. Violation of the conditions set forth on such signs shall be deemed a violation of Section 3115 of Los Angeles County Ordinance No. 6544 as adopted by the city.

A. 
For purposes of this chapter, the following terms shall have the meaning set forth below:
1. 
"Vehicle" means "vehicle" as provided in Section 670 of the California Vehicle Code as that section may be amended from time to time, and shall include trucks, recreational vehicles, boats and trailers.
2. 
"Front yard" means that portion of the residential property as defined in Section 11.01.030 of the La Cañada Flintridge Zoning Code.
B. 
No person shall park or store a vehicle, nor shall a property owner and/or occupant allow a vehicle to be parked or stored, on any portion of the front yard of the property other than on the driveway or other area specifically designed and constructed for vehicle parking.

Any person whose vehicle is properly impounded by a sworn or non-sworn representative of the city's policing authority for violation of any section or provision of the California Vehicle Code, the Los Angeles County Code, or the La Cañada Flintridge Municipal Code relating to duly adopted parking restrictions and/or traffic and vehicle restrictions as is enumerated in the adopted parking citation bail schedule, shall be liable to the city for paying the corresponding administrative costs relating to the removal, impound, storage, or release of the vehicles as established by resolution of the city council of the city of La Cañada Flintridge. Failure to do so shall constitute a violation of this chapter. The administration charges imposed pursuant to this section shall be in addition to any other charges which have been assessed to the vehicle.

Any person who receives or is otherwise issued a parking citation from a sworn or non-sworn representative of the city's policing authority for violation of any section or provision of the California Vehicle Code, the Los Angeles County Code, or the La Cañada Flintridge Municipal Code relating to duly adopted parking restrictions and/or traffic and vehicle restrictions as is enumerated in the adopted parking citation bail schedule, shall be liable to the city to pay the corresponding bail amount as established by resolution of the city council of the city of La Cañada Flintridge. Failure to do so shall constitute a violation of this chapter.

A. 
An assessment of $5 shall be added to each parking penalty under Section 4.04.200, consisting of $2.50 assessed for the courthouse construction fund pursuant to Sections 76100 and 76219 of the California Government Code and $2.50 assessed for the criminal justice facilities construction fund pursuant to Section 76101 of the California Government Code.
B. 
Under Section 1465.5 of the Penal Code of the state of California, an additional penalty of $2 for every $10 or fraction thereof shall be assessed pursuant to Section 42001.5 of the Vehicle Code for violations of the handicapped parking laws set forth in Section 22507.8 of the Vehicle Code.
C. 
Under Section 1465.6 of the Penal Code of the state of California, the penalty assessed for a violation of Section 22507.8 of the Vehicle Code and the penalty assessed for a violation of Section 22522 of the Vehicle Code shall be increased by ten percent.

A. 
Additional penalties and the administrative fee provided in this section for delinquent parking violations shall be assessed upon filing of notice of delinquent parking violation with the Department of Motor Vehicles, state of California, in accordance with the procedures set forth in Sections 40206 through 40220 of the Vehicle Code of the state of California.
B. 
If the penalties provided in Sections 4.04.200 and 4.04.210 are not paid by the day provided in the notice of parking violation, the penalty shall increase to the twenty-one-day late penalty for parking violation penalties not paid within 21 days of the issuance of a notice of parking violation, and shall increase to the thirty-five-day late penalty for parking violation penalties not paid within 35 days of the issuance of a notice of parking violation.
C. 
In addition to the penalty for delinquent parking penalty violation provided in subsection B of this section, and in addition to the penalty provided in Sections 4.04.200 and 4.04.210 in the case of a violation of Sections 22507.8, 22522, 22500, subdivision (i) or 22500, subdivision (1) of the Vehicle Code of the state of California, an administrative fee of $15 shall be assessed on all delinquent parking violations.
