For purposes of this chapter, the following definitions shall apply:
"La Cañada Flintridge based private citizen or private organization"
means:
A. 
In the case of an individual, a person whose principal place of residence is in the city;
B. 
In the case of a group, an organization or collective of people, one in which at least half of its members, or at least 350 members, whichever is less, have their principal place of residence in the city.
C. 
In the case of a business or nonprofit organization, one which has a bona fide place of business in the city.
"Parade"
means any march, demonstration, procession, race or motorcade consisting of persons, animals or vehicles, or combination thereof, upon the streets, parks or other public grounds within the city with an intent of attracting public attention that interferes with, or has a tendency to interfere with, the normal flow or regulation of traffic upon the streets, parks or other public grounds.
"Parade or special event permit"
means a permit as required by this chapter.
"Person"
means any person, firm, partnership, association, corporation, company or organization of any kind.
"Sidewalk"
means any area or way set aside or open to the general public for purposes of pedestrian traffic, whether or not it is paved.
"Special event"
means any ceremony, pageant, review, carnival, fiesta, circus or athletic event which is not a race, in or upon any public street, sidewalk, park or alley which would otherwise be subject to normal and usual traffic regulation or field or park use regulation and controls.
"Street"
means any place or way set aside or open to the general public for purposes of vehicular traffic, including any berm or shoulder parkway, right-of-way or median strip thereof.
"Street vendor" or "street vending"
means the transitory sale of goods, food or wares, including, but not limited to, balloons, toys, popcorn, confections, ice cream, souvenirs, etc., for purposes of commercial profit-making, by a vendor authorized by the permittee and who has obtained a valid city business license. Such vending must be transitory in nature, i.e., peddling/sales on foot, from a cart, bicycle or mobile stand, and not from a fixed stationary position, booth or structure nor from a motorized vehicle.

No person shall engage in or conduct any parade or special event unless a permit is issued by the city manager or designee. No permit shall be issued authorizing the conduct of a parade or special event which the city manager or designee determines is to be held solely for the purpose of advertising any product, goods, wares, merchandise or that is being conducted purely for private profit-making purposes.

This chapter shall not apply to the following:
A. 
Funeral processions;
B. 
Students going to and from school classes or participating in educational activities, provided that such conduct is under the immediate direction and supervision of the proper school authorities;
C. 
A governmental agency acting within the scope of its functions;
D. 
Spontaneous events occasioned by news or affairs coming into public knowledge within three days of such parade or special event provided that the organizer thereof gives written notice to the city at least 24 hours prior to such spontaneous event;
E. 
Film/still photography activity conducted pursuant to a valid city permit;
F. 
Special events which take place wholly on private property. Such events are regulated by other provisions of this code.

A. 
A person seeking a parade or special event permit shall file an application with the city manager or designee on forms provided by the city and the application shall be signed by the applicant under oath.
B. 
For a single, nonrecurring parade or special event, an application for a permit shall be filed with the city manager or designee at least ten days and not more than 180 days before the parade or special event is proposed to commence. The city manager or designee may waive the minimum ten-day filing period and accept an application filed within a shorter period if, after due consideration of the date, time, place and nature of the parade or special event, the anticipated number of participants, and the city services required in connection with the event, the city manager or designee determines that the waiver will not present a hazard to public safety.
C. 
For parades or special events held on a regular or recurring basis at the same location, an application for a permit covering all such parades or special events during that calendar year may be filed with the city manager or designee at least 60 days and not more than 180 days before the date and time at which the first such parade or special event is proposed to commence. The city manager or designee may waive the minimum 60 day period after due consideration of the factors specified in subsection B of this section.
D. 
The application for a parade or special event permit shall set forth the following information:
1. 
The name, address and telephone number of the person seeking to conduct such parade or special event;
2. 
The names, addresses and telephone numbers of the headquarters of the organization for which the parade or special event is to be conducted, if any, and the authorized and responsible heads of the organization;
3. 
If the parade or special event is designed to be held by, or on behalf of, any person other than the applicant, the applicant for such permit shall file a letter from that person with the city manager or designee authorizing the applicant to apply for the permit on his or her behalf;
4. 
The type of parade or special event, including a description of the activities planned during the event;
5. 
The purpose of the parade or special event;
6. 
The requested date of the parade or special event;
7. 
The route to be traveled, if any, including the starting point and the termination point;
8. 
The approximate number of persons who, and animals and vehicles which will constitute such parade or special event, and the type of animals and description of the vehicles that will be participating;
9. 
The hours when such parade or special event will start and terminate;
10. 
A statement as to whether such parade or special event will occupy all or only a portion of the width of the streets proposed to be traversed or occupied;
11. 
The location by street of any assembly areas for such parade or special event;
12. 
A copy of the liquor license issued by California Alcohol Beverage Control when alcoholic beverages are to be sold;
13. 
The number and location of sanitation or other health facilities including restrooms and first aid stations;
14. 
Whether any person(s) will ride, drive or cause to be ridden or driven any animal or animal-drawn vehicle upon any public street;
15. 
The location and number of parking places which will accommodate the anticipated number of vehicles reasonably expected;
16. 
Whether any street vending will be authorized by the permittee and the name(s) and address(es) of such authorized street vendor(s);
17. 
The time at which units or equipment of the parade or special event will begin to assemble at any such area;
18. 
Minimum speed of parade units;
19. 
Maximum speed of parade units;
20. 
The intervals of space to be maintained between units of such parade or special event;
21. 
A description of any recording equipment, sound amplification equipment, lighting, banners, signs and attention-getting devices, to be used in connection with the parade or special event;
22. 
The approximate number of participants (spectators are, by definition, not participants);
23. 
The approximate number of spectators;
24. 
A designation of any public facilities or equipment to be utilized;
25. 
Any additional information that the city manager or designee finds reasonably necessary to a fair determination as to whether a permit should issue.

A. 
A nonrefundable application fee of $100 to cover administrative costs of processing the permit and coordinating various city services shall be paid to the city by the applicant when the application is filed. City services include, but are not limited to, costs incurred for traffic engineer review, traffic control devices, and Los Angeles County sheriff's department fees.
B. 
If any city services shall be required for the parade or special event, the applicant shall, prior to the issuance of a permit, agree to reimburse the city, upon receipt of an invoice from the city, the actual costs for providing such services.
C. 
If the application is for the use of any city property, excepting sidewalks or streets, the fee shall be that which has been established by the current city ordinance or resolution pertaining to park/designated recreational facility use or public facility fee. All use fees shall be paid prior to commencement of the parade or special event.

Fees or costs imposed by this chapter may be waived under the circumstances described in this section and as shown in table below.
A. 
The following fees and costs are eligible for waiver:
1. 
Category A fees: Application fee;
2. 
Category B fees: Fees and costs totaling nine hundred ninety-nine dollars ($999.99) or less for traffic engineer review, traffic control devices, and Los Angeles County sheriff's department fees; and
3. 
Category C fees: Fees and costs totaling $1,000 or more for traffic engineer review, traffic control devices, and Los Angeles County sheriff's department fees.
B. 
The following applicants are eligible for fee waivers:
1. 
Local public entities such as county agencies, school districts, and special districts;
2. 
501(c)(3) nonprofit organizations; and
3. 
La Cañada Flintridge based private citizens or private organizations such as neighborhood watch groups, sports groups/organizations, neighborhood engagement committees, and other informal citizens groups such as PTAs and student organizations.
C. 
Applicants seeking a waiver of fees shall submit a fee waiver application to the city manager or designee concurrently with the permit application. Fee waiver applications must be submitted on a form approved by the city.
D. 
The city manager or designee is authorized to waive Category A and Category B fees. Only the city council may waive Category C fees.
E. 
Fee waivers shall be granted to eligible applicants in accordance with the following criteria:
1. 
Local public entities:
a. 
Shall automatically receive a waiver of Category A fees;
b. 
Shall automatically receive a waiver of Category B fees; and
c. 
May receive a waiver of Category C fees if the city is a co-sponsor or endorser of the parade or special event.
2. 
501(c)(3) nonprofit organizations:
a. 
Shall automatically receive a waiver of Category A fees;
b. 
May receive a waiver of Category B fees if:
i. 
The organization has a bona fide place of business in the city, and
ii. 
The parade or special event provides a community benefit and has a community purpose; and
c. 
May receive a waiver of Category C fees if:
i. 
The organization has a bona fide place of business in the city,
ii. 
The parade or special event provides a community benefit and has a community purpose,
iii. 
The parade or special event is open to the public, and
iv. 
The parade or special event has a philanthropic, educational, or recreational purpose.
3. 
La Cañada Flintridge based private citizens or private organizations:
a. 
May receive a waiver of Category A fees if the parade or special event provides a community benefit and has a community purpose;
b. 
May receive a waiver of Category B fees if:
i. 
The parade or special event is open to the public or a segment thereof and is not a private or exclusive event, and
ii. 
The parade or special event aligns with a goal or objective adopted by the city council; and
c. 
May receive a waiver of Category C fees if:
i. 
The parade or special event provides a community benefit and has a community purpose,
ii. 
The parade or special event is open to the public or a segment thereof and is not a private or exclusive event,
iii. 
The parade or special event aligns with a goal or objective adopted by the city council,
iv. 
The parade or special event has a philanthropic, educational, or recreational purpose, and
v. 
The City is a co-sponsor or endorser of the parade or special event.

F. 
Any decision regarding a fee waiver by the city manager or designee may be appealed to the city council by any interested party within 15 calendar days following the date of decision. Notice of such appeal must be filed in the office of the city clerk together with any required fees and shall be accompanied by a written statement setting forth the reason to appeal. The city clerk shall set the matter for public hearing, giving notice to the appellant at least ten days prior to the hearing. Following such hearing the city council shall consider the matter and may affirm, reverse, or modify the determination of the city manager or designee.
G. 
Any determination of the city council, whether on appeal or on a determination of a Category C waiver, shall be final and effective immediately.
H. 
If a parade or special event occurs before a fee waiver request can be reviewed by the city, the applicant shall pay the permit fees prior to the issuance of the permit and the city shall reimburse any fees for which a waiver is subsequently approved.

The Los Angeles County sheriff's department shall determine whether, and to what extent, additional law enforcement protection is reasonably necessary for the parade or special event for traffic control and public safety purposes. The sheriff's department shall base its decision on the size, location, duration, time and date of the event, the expected sale or service of alcoholic beverages, the number of streets and intersections to be blocked or impacted, and the need to detour or preempt citizen travel and use of the sidewalks and streets. The speech content of the event shall not be a factor in determining the amount of law enforcement protection necessary. If possible, without disruption of ordinary law enforcement services or compromise of public safety, regularly scheduled on-duty personnel will police the event. If additional law enforcement protection is deemed necessary for the parade or special event, the sheriff's department shall so inform the permit applicant. The applicant shall then have the duty to secure the law enforcement protection at his or her sole expense.

An applicant for a parade or special event permit shall agree to indemnify, defend, and hold harmless the city of La Cañada Flintridge, its officers, agents and employees from and against any and all liability, and expense, including defense costs and legal fees, and claims for damages of any nature whatsoever, including, but not limited to, bodily injury, death or property damage arising from any negligent or intentional act or omission by permittee or event organizer/sponsor, its subcontractors, officers and employees, in the conduct of the parade or special event.

A. 
The city manager or designee shall issue a permit as provided for herein when, from a consideration of the application and from such other information as may otherwise be obtained, he or she finds that:
1. 
The application has been fully completed and signed by the applicant;
2. 
The conduct of the parade or special event will not substantially interrupt the safe and orderly movement of other pedestrian or vehicular traffic contiguous to its route or location;
3. 
The conduct of the parade or special event will not require the diversion of so great a number of sheriff's deputies to properly police the line of movement and the areas contiguous thereto as to prevent normal law enforcement protection of the city;
4. 
The concentration of persons, animals and vehicles at assembly points of the parade or special event will not unduly interfere with proper fire and law enforcement protection of, or ambulance service to, areas contiguous to such assembly areas;
5. 
The conduct of the parade or special event is not reasonably likely to cause injury to persons or property;
6. 
The parade or special event is scheduled to move from its point of origin to its point of termination expeditiously and without unreasonable delays en route;
7. 
Adequate sanitation and other required health facilities are or will be made available in or adjacent to any assembly areas;
8. 
There are sufficient parking places near the site of the parade or special event to accommodate the number of vehicles reasonably expected;
9. 
The applicant has secured the law enforcement protection, if any, as required under Section 4.05.060;
10. 
Such parade or special event is not for the primary purpose of advertising any product, goods or event that is primarily for private profit, and the parade or special event itself is not primarily for profit. The prohibition against advertising any product, goods or event shall not apply to signs identifying organizations or sponsors furnishing or sponsoring exhibits or structures used in the parade or special event;
11. 
No parade or special event permit application for the same time and location is already granted or has been received and will be granted;
12. 
No parade or special event permit application for the same time, but not location, is already granted or has been received and will be granted, and the law enforcement resources required for the prior parade or special event are so great that in combination with the subsequent proposed application, the resulting deployment of law enforcement services would have an immediate and adverse effect upon the welfare and safety of persons and property;
13. 
No event is scheduled elsewhere in the city where the law enforcement resources required for that event are so great that the deployment of law enforcement services for the proposed parade or special event would have an immediate and adverse effect upon the welfare and safety of persons and property;
14. 
No parade or special event application shall be for an event occurring or operating for more than five consecutive days.
B. 
No permit shall be granted that allows for the erection or placement of any structure, whether permanent or temporary, on a city street, sidewalk, park or right-of-way, unless advance approval for the erection or placement of the structure is obtained from the director of public works. Such structure shall comply with the provisions of the city's building code.

The city manager or designee shall uniformly consider each application upon its merits and shall not discriminate in granting or denying permits under this chapter based upon political, religious, ethnic, race, disability, sexual orientation or gender related grounds.

The city manager or designee shall act promptly upon a timely filed application for a parade or special event permit, but in no event shall grant or deny a permit less than 48 hours prior to the event. If the city manager or designee determines that he or she will disapprove the application, he or she shall notify the applicant either by personal delivery or certified mail at least 48 hours prior to his or her action and state the reasons for denial. The applicant may respond with additional information or clarification up to 48 hours prior to the event, or may appeal such determination in accordance with Section 4.05.110.

A. 
The city manager or designee, in denying an application for a parade or special event permit, may authorize the conduct of the parade or special event at a date, time, location or route different from that specified by the applicant. An applicant desiring to accept an alternate permit shall, within five days after notice of the action of the city manager or designee, file a written notice of acceptance with the city manager or designee.
B. 
An alternate parade or special event permit shall conform to the requirements of, and shall have the effect of, a parade or special event permit issued under this chapter.

A. 
Any applicant shall have the right to appeal the denial of a parade or special event permit to the city council. The denied applicant shall make the appeal within five days after receipt of the denial by filing a written notice with the city manager or designee with a copy of the notice submitted to the city clerk. The city council shall act upon the appeal at the next regularly scheduled meeting following receipt of the written notice of appeal.
B. 
In the event that the next regularly scheduled city council meeting is to be held after the proposed commencement date of the event, or in the event the city council rejects an applicant's appeal, the applicant may file an immediate request for review with a court of competent jurisdiction.

Immediately upon the issuance of a parade or special event permit, the city manager or designee shall send a copy thereof to public agencies that will be impacted by, or whose services will be required for, the parade or special event. Such public entities may include, but are not limited to, the sheriff's department, the fire department, and public utilities.

Each parade or special event permit shall state or include the following information:
A. 
Date(s), hours, starting and approximate ending time;
B. 
A statement of indemnification as required by this chapter;
C. 
Minimum speed of parade units;
D. 
Maximum speed of parade units;
E. 
Maximum interval of space to be maintained between parade units;
F. 
The portions of the sidewalks, streets, parks or other public property that may be occupied by the parade or special event;
G. 
The maximum length of the parade in miles or fractions thereof;
H. 
A copy of the liquor license issued by California Alcohol Beverage Control when alcoholic beverages are to be sold;
I. 
The authorized number and location of sanitation or other required health facilities including restrooms and first aid stations;
J. 
Whether any person(s) will be authorized to ride, drive or cause to be ridden or driven any animal or animal-drawn vehicle upon any public street;
K. 
The location(s) and number of parking places which will accommodate the anticipated number of vehicles reasonably expected;
L. 
Whether any street vending will be authorized by the permittee and the name(s) and address(es) of such authorized street vendor(s);
M. 
Such other information as the city manager or designee shall find necessary to the enforcement of this chapter.

A. 
A permittee hereunder shall comply with all permit directions and conditions and with all applicable laws and ordinances.
B. 
The parade or special event chairman, or other person heading such activity, shall carry the parade or special event permit upon his or her person during the conduct of the parade or special event.

The following prohibitions shall apply to all parades and special events:
A. 
It is unlawful for any person to stage, present or conduct any parade or special event without first having obtained a permit as provided herein.
B. 
It is unlawful for any person to participate in a parade or special event for which the person knows a permit has not been granted.
C. 
It is unlawful for any person in charge of, or responsible for, the conduct of a duly licensed parade or special event, to knowingly fail to comply with any condition of the permit.
D. 
It is unlawful for any person to engage in any parade or special event activity that would constitute a substantial hazard to the public safety or that would materially interfere with or endanger the public peace or rights of residents to the quiet and peaceful enjoyment of their property.
E. 
It is unlawful for any person participating in any parade or special event to carry or possess any length of metal, lumber, wood or similar material for purposes of displaying a sign, poster, plaque or notice, unless such object is one-fourth inch or less in thickness and two inches or less in width or, if not generally rectangular in shape, such object shall not exceed three-fourths inch in its thickest dimension.
F. 
It is unlawful for any person to carry any sign, poster, plaque or notice, whether or not mounted on a length of material as specified in subsection E of this section, unless such sign, poster, plaque or notice is constructed or made of a cloth, paper or cardboard material.
G. 
It is unlawful for any person participating in a parade or special event to fail to comply with the provisions of Ch. 5.02, Regulation of Community Noise.
H. 
It is unlawful for any person to ride, drive or cause to be ridden or driven, any animal or any animal-drawn vehicle upon any public street unless specifically authorized by the permit.
I. 
It is unlawful for any person to conduct a parade or special event during the hours of eleven-thirty p.m. of any one day through six a.m. of the following day unless such conduct is specifically authorized by the city council.

A. 
It is unlawful for any person to interfere with, disrupt or impede a permitted parade or special event. The following acts are prohibited by this section when performed for the purpose, or with knowledge that an effect thereof, is to interfere with or disrupt the ability of the permittee to carry on the parade or special event:
1. 
To block, obstruct or impede the participation or passage of participants, vehicles or animals in the parade or special event;
2. 
When not an authorized participant or unit in the parade or special event, to walk, run, operate a skateboard, ride any wheeled vehicle or rollerskate or other wheeled toy, or drive a vehicle through, between, within or among the authorized participants, vehicles or animals in the parade or special event without the permission of the permit holder, except in cases of bona fide emergency;
3. 
To drop, roll, throw, toss, squirt or propel any gaseous, liquid, semi-solid or solid substance or object toward or among the participants, vehicles or animals in the parade or special event or toward or among the spectators of the parade or special event unless specifically authorized by the permittee;
4. 
To grab, take hold of, strike, hit, pull or push any participant, vehicle or animal in the parade or special event, or to mount any vehicle in the parade or special event, except with the permission of the permittee or in cases of bona fide emergency.
B. 
The city manager or designee shall have the authority, when reasonably necessary, to prohibit or restrict the parking of vehicles along a street constituting a part of the parade or special event. The applicant is responsible for requesting no parking signs from the public works department and posting them 72 hours in advance from the date of the event. No person shall be liable for parking on a street unposted in violation of this chapter.

All street vending on public sidewalks, streets, parks, rights-of-way or public property being utilized for a parade or special event pursuant to a validly issued permit, shall be prohibited unless it is specifically authorized by the permit and the street vendor(s) have been identified and specifically authorized by the permittee and the street vendor(s) have obtained a valid city-issued business license.

All commercial vending on public sidewalks, streets, parks, rights-of-way or public property shall be subject to the provisions of this code.

The city manager or designee shall have the authority to revoke a parade or special event permit instantly upon violation of the conditions or standards for issuance as set forth in this chapter or when a public emergency arises where the law enforcement resources required for that emergency are so great that deployment of law enforcement services for the parade or special event would have an immediate and adverse effect upon the welfare and safety of persons or property.

Any person who violates Section 4.05.160, 4.05.163 or 4.05.165 of this chapter shall be guilty of an infraction. Any person violating provision(s) of any other section of this chapter, shall be guilty of a misdemeanor. Penalties for such violation(s) shall be imposed as set forth in Chapter 1.04 of this code.
