This chapter is intended to prohibit the feeding of unconfined wildlife in any public park, public right-of-way, open space, or on any property owned or operated by City of Lake Forest, so as to protect public health, safety and welfare, and to prescribe penalties for failure to comply.

"Designated premises"
means any public park, public right-of-way, open space, or on any property owned or operated by City of Lake Forest that has been designated pursuant to Section 10.22.030 for purposes of this chapter by the Community Services Commission as being at risk of an overpopulation of wildlife.
"Enforcement officer"
means a law enforcement officer employed or otherwise charged by the City to enforce codes, ordinances, mandates, regulations, resolutions, rules or other laws adopted by the City, including an officer employed by the City, a staff member of the City Code Enforcement Division, Orange County Animal Control, or an officer providing services to the City under contract.
"Feed"
means to give, place, expose, deposit, distribute or scatter any edible material with the intention of feeding, attracting, or enticing wildlife. Feeding does not include: (1) baiting in the legal taking of fish and/or game; (2) or feeding authorized by City contract.
"Open space,"
as defined in Section 9.04.030 of this Code, means any parcel or area of land or water, public or private, which is reserved for the purpose of preserving natural resources, for the protection of valuable environmental features, or for providing outdoor recreation or education. For the purposes of this chapter, "open space" shall only include areas that are available and accessible to public use.
"Park"
means any community park, neighborhood park, or any other recreational facility maintained for the beneficial use of the public.
"Person"
means any individual, corporation, company, partnership, firm, association, or political subdivision of this State subject to municipal jurisdiction.
"Wildlife"
means an animal that is neither human nor domesticated.

The Community Services Commission shall periodically approve or amend by resolution a list of designated premises at a noticed public meeting that the Commission has determined as being at risk for an over-population of wildlife. The list of designated premises for purposes of this chapter shall be published on the City's website and available for public inspection in the office of the City Clerk.

A. 
Prohibited Conduct. No person shall feed, on any designated premises, any wildlife, excluding confined wildlife (for example, wildlife confined in zoos, rehabilitation centers, or unconfined wildlife at environmental education centers, or feral cats as part of an approved trap-neuter-release program).
B. 
Enforcement.
1. 
This section shall be enforced by an enforcement officer.
2. 
Any person found to be in violation of this section shall be subject to the penalties provided in Section 10.22.050 of this chapter.

A. 
Every act prohibited or declared unlawful and every failure to perform an act made mandatory by this chapter is a misdemeanor punishable in accordance with Section 1.01.200 et seq., of this Code.
B. 
Nothing herein shall prevent the City from taking such lawful action as is necessary to prevent or remedy any violation, including the use of administrative citations pursuant to Chapter 1.16 of this Code. Administrative fines assessed for violations of this chapter shall be governed by City Council Resolution pursuant to Section 1.16.070.
