To protect public health, safety and well-being, the keeping of solid waste in collection containers or commercial bins or detachable bins other than those approved by collector, or the keeping upon premises of solid waste which is offensive, obnoxious or unsanitary is unlawful, constitutes a public nuisance and may be abated in the manner now or hereafter provided by law for the abatement of nuisances.

To protect public health, safety and well-being, no person, other than the person in charge of any premises, or the collector authorized by the person in charge of any premises, shall remove any container or commercial bin from the location where the container or commercial bin was placed for storage or collection by the person in charge or the premises, or remove any solid waste, including recyclable solid waste and green waste, from any container or commercial bin, or move the container or commercial bin from the location in which it was placed for storage or collection, without prior written approval of the person in charge of such premises.

To protect public health, safety and well-being, to minimize interference with public rights-of-way, no person shall place bulky goods adjacent to a street or public right-of-way for collection or removal purposes without prior approval and arrangements with a collector.

To protect public health, safety and well-being, no person shall burn any solid waste within the City, except in an approved incinerator or transformation facility or other device for which a permit has been issued by the building official, and which complies with all applicable permit and other regulations of air pollution control authorities, and provided any such act of burning in all respects complies with all other laws, rules and regulations.

To protect public health, safety and well-being, it is unlawful and a misdemeanor, subject to punishment in accordance with Section 1.01.200 et seq. of this Code, for any person, except for a self-hauler or gardener, to collect any solid waste from any commercial premises or residential premises within the City, nor shall any person place a commercial bin, at any premises within the City, without a City-issued written franchise or written solid waste collector's permit. Each day any person, other than a self-hauler or gardener, collects any solid waste from any commercial premises or residential premises within the City, or place a commercial bin for the accumulation of solid waste at any premises within the City, or permit or suffer a commercial bin to remain in any place within the City, without a City solid waste collector's permit shall constitute a separate offense.

To protect public health, safety and well-being, and to prevent the spread of vectors, it is unlawful for any person, other than a person holding a contract, franchise, permit or license for the collection of solid waste, issued by the City Council in writing and naming the holder of such contract, franchise, permit or license, to take, remove or appropriate for his/her own use any solid waste, including recyclable solid waste and green waste, which has been placed for collection or removal, whether so placed in containers or commercial bins or detachable bins or not.

To protect public health, safety and well-being and to prevent the spread of vectors, it is unlawful, and a public nuisance, for any person to occupy, inhabit, maintain, or to be in day-to-day control of any property within the City for which appropriate arrangements have not been made for either regular collection and removal services or self haul removal of solid waste, including recyclable solid waste and green waste.

To protect public health, safety and well-being, and to prevent the contamination of solid waste, including recyclable solid waste and green waste, it is unlawful for any person to place solid waste in, or to otherwise use the solid waste, recyclable solid waste or green waste containers or commercial bins or detachable bins of another person, without the permission of such other person.

To protect public health, safety and well-being, it is unlawful for any person transporting solid waste, including recyclable solid waste and green waste, not to clean up, or arrange for the cleanup, of any solid waste released, spilled or dumped during removal or transport within the City by such person.

It is unlawful for any person to deposit, release, spill, leak, pump, pour, emit, empty, discharge, inject, dump or dispose into the environment, including the abandonment of or discarding of barrels, containers and other closed receptacles of solid waste of any kind whatsoever, any solid waste upon any property within the City, or to cause, suffer, or permit such solid waste to come to be located upon any property in the City, except as authorized by Title 16, Title 15 or Title 9 of the Lake Forest Municipal Code.

Pursuant to California Penal Code Section 836.5, the Director of Public Works/City Engineer, the Director of Community Development, and any City Code Enforcement Officer are authorized to enforce the provisions of this title and as well as those of California Penal Code Sections 374, 374a, 374.2, 374.3, 374.4, 374d, 374.7, and 375; California Government Code Section 68055 et seq.; and California Vehicle Code Sections 23111 and 23112.

Except as otherwise provided in this title, violations of this chapter are misdemeanors and subject the violator to punishment as set out in Sections 1.01.200 through 1.01.260 of this Code.

The City Manager or designee thereof shall have the authority to enforce the provisions of this title. This authority shall be in addition to the authority granted to police officers pursuant to the Municipal Code.

Nothing in this title shall be deemed to limit the right of a contractor to bring a civil action against any person who violates Section 16.11.030 of this Code, nor shall a conviction for such violation exempt any person from a civil action brought by a contractor.
