A. 
On November 19, 1985, the Board of Supervisors of the County of Sacramento adopted Resolution No. 85-1728 granting approval, pursuant to the requirements of Section 70(d)(2) of the California Penal Code, for Deputy Sheriffs of Sacramento County to be employed, outside of their regular employment, as private security guards or patrolmen for private employers, subject to the rules and regulations set down for such employment by Penal Code Section 70(d) and the Sacramento County Sheriff.
B. 
By General Order, the Sacramento County Sheriff, pursuant to Penal Code Section 70 and Government Code Sections 1126 and 1127, has adopted rules and regulations governing off duty employment by Deputy Sheriffs (herein "auxiliary system")
C. 
The provisions of this chapter establishing a fee associated with the administrative costs of the auxiliary system are authorized by Penal Code Section 70 and the California Constitution, Article XI, Section 7.
D. 
Enactment of the fee is necessary in order to provide a source of revenue with which to defray the personnel and other costs incurred by the County in administering the auxiliary system. The costs incurred by the County to administer the auxiliary system are not met by any other source and County revenues are insufficient to cover such costs.

A. 
Effective December 1, 2022, the following fees shall be paid to the County of Sacramento by any person, corporation, partnership, public entity, charitable organization, association, or any other entity requesting and receiving services of off-duty Deputy Sheriffs pursuant to the auxiliary system: (1) an administrative fee of fifteen dollars per hour per deputy; and (2) an additional fee of seventeen dollars per hour per deputy if the deputy is equipped with a marked patrol unit provided by the Sheriff's Office.
B. 
The Sacramento County Sheriff may, in his or her discretion, waive, in whole or in part, those fees referenced in subsection (A) if it is verified that local governmental funding received from the County of Sacramento, the City of Sacramento or the Sacramento Housing and Redevelopment Agency is being dedicated, in whole or in part, by any person, corporation, partnership, public entity, charitable organization, association, or any other entity requesting and receiving services of off-duty Deputy Sheriffs to funding the services of those off-duty Deputy Sheriffs.
C. 
The Sacramento County Sheriff shall be responsible for the collection of the fee prescribed by this chapter and to adjust the fees annually, provided they do not exceed the Consumer Price Index (CPI).
D. 
The Sacramento County Sheriff shall, by General Order, adopt rules and regulations to implement collection of the fee prescribed by this chapter.
