The purpose of this article is to deal with temporary conditions arising on the County's waterways which pose serious risks to persons.

The authority to designate an emergency condition is vested in the sheriff of Sacramento County. The sheriff shall contact adjoining counties and other concerned agencies as soon as possible to report the emergency condition and to confirm the designation.
Any designation or emergency conditions shall be in effect no longer than seven days unless extended by the Board of Supervisors and approved by all other appropriate agencies.

The designation must contain an identifying description of the area, a brief statement of the conditions constituting an emergency and the type or types of restrictions to be placed upon the use of the area.

The designation of emergency conditions may order the closure of an area to the use of power vessels, vessels without power, floating devices, swimming, waterskiing or any other water-oriented activity subject to local control, including the use of launching areas.

Upon the designation of an emergency condition as provided for in Section 2, the sheriff shall close the area to the type of use designated.

A violation of any of the provisions or regulatory requirements of any of the provisions of Article 2, Chapter 13.08, of Title 13 shall constitute a misdemeanor.
