In accordance with V.T.C.A., Texas Local Government Code, section 22.071, the position of City Manager is hereby established as that of a municipal officer of the city. The City Council ("council") shall fill the position of City Manager by appointment based solely on the person's administrative ability. The City Manager serves at the will of the council. The City Manager is not required to meet any residency qualifications.

If required by the council, the City Manager must execute a bond in such amount prescribed by ordinance or resolution. The bond must be conditioned that the City Manager will faithfully perform the duties of the position. The premium for such bond shall be paid by the city.

(a) 
The City Manager shall implement the policies, goals, and objectives approved by the City Council in coordination with the other municipal officers.
(b) 
The City Manager shall perform the duties as set forth:
(1) 
In the job description maintained on file with the city;
(2) 
In any written agreement between the city and the City Manager; and
(3) 
By ordinance or resolution by the council.

The City Manager is hereby authorized to determine which streets in the city need repair and/or maintenance and ensure that such work is performed in an efficient, cost-effective manner. The City Manager is authorized to expend budgeted city money on street maintenance and repair up to the annual budgeted amounts for said work, but in no event shall the City Manager spend more than $25,000.00 on one or more street maintenance and repair projects without prior City Council approval. In making the street maintenance and repair decisions, the City Manager shall consider the desires of the City Council.

(a) 
The City Manager is responsible for the administration, direction, and coordination of all employees of the city according to the established organization procedures.
(b) 
The City Manager shall recommend to the council the appointment, promotion, evaluation, and, when necessary for the good of the city, the suspension or termination of municipal officers.
(c) 
In consultation with the appropriate department head, the City Manager will be responsible for the appointment, promotion, evaluation, and, when necessary for the good of the city, the suspension or termination of employees below officer level.
(d) 
The City Manager shall serve as personnel officer for the city with responsibilities to:
(1) 
See that complete and current personnel records, including specific job descriptions, for all city employees are kept;
(2) 
Evaluate, in conjunction with department heads, the performance of all employees on a regular basis;
(3) 
Recommend salary and wage scales for city employees;
(4) 
Develop and enforce high standards of performance by city employees;
(5) 
Assure that city employees have proper working conditions; and
(6) 
Work closely with department heads to promptly resolve personnel problems or grievances.

(a) 
The council retains and reserves for itself the power to amend, revoke, or repeal any action of the City Manager not previously approved by the council.
(b) 
The council retains the final hiring and firing authority for municipal officers as defined by section 22.071 of the Local Government Code or the ordinances of the city.
(c) 
The council establishes itself as an appellate governmental body for any appeals, grievances, or requests for reconsideration of acts or omissions by the City Manager.
