A parcel map shall be filed and recorded for any subdivision for which a tentative and final map is not required by the Subdivision Map Act, except for subdivisions created by short-term leases (terminable by either party on not more than thirty days' notice in writing) of a portion of an operating right-of-way of a railroad corporation defined as such by Section 230 of the Public Utilities Code, or for land conveyed to or from a governmental agency, public entity or public utility, or to a subsidiary of a public utility for conveyance to such public utility for rights-of-way; provided, however, that upon a showing made to the planning commission based upon substantial evidence that public policy necessitates such a map, this exception shall not apply.
(Ord. 379, 1975; Ord. 455 § 1, 1980)
Dedications or offers of dedication of public ways, access rights and abutter's rights, drainage and public utility easements, building restriction rights and other public easements may be required for a minor land division or parcel map.
(Ord. 379, 1975; Ord. 386 § 2, 1975)
If dedications or offers of dedication are required for a minor land division or parcel map, they may be made either by certificate on the parcel map or by separate instrument.
(Ord. 379, 1975; Ord. 386 § 2, 1975)
The signatures of all parties having any record title interest in the real property being subdivided shall not be required on any final parcel map unless dedications or offers of dedication are made by certificate on the parcel map.
(Ord. 379, 1975; Ord. 386 § 2, 1975)
Evidence of title shall be submitted with all final parcel maps. This shall show all fee interest holders, all interest holders whose interest could ripen into a fee, all trust deeds together with the name of the trustee, and all easement holders.
(Ord. 379, 1975; Ord. 386 § 2, 1975)
When a parcel map is required by this title, a tentative parcel map shall first be filed with the planning commission. Said map shall meet all the requirements for tentative maps provided by the Subdivision Map Act and this title.
(Ord. 379, 1975)
Pursuant to Government Code Section 66428, parcel maps required by Division 2 of Title 7 of the Government Code may be waived by the city council with respect to a proposed division of land where the city council finds and determines that the proposed division of land involves unique circumstances which make it unnecessary to require a parcel map to carry out the intent and purpose of the Subdivision Map Act and provided the city council further finds and determines that the proposed division of land complies with such requirements as may have been established by Division 2 or local ordinance enacted pursuant thereto as to area, improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability, environmental protection, and other requirements of this division or local ordinance enacted pursuant thereto.
(Ord. 420 § 1, 1978)
