In order to determine the suitability of alternative materials and methods of construction and to provide for reasonable interpretations of the provisions of the technical codes, there shall be and is hereby created a Building Code Board of Appeals.
A. 
The Board shall consist of seven members, appointed by the City Council.
B. 
Five members shall be qualified by experience and training to pass upon matters pertaining to building construction and building service equipment to the satisfaction of the City Council. Two members shall be lay members of the community.
C. 
Each member of the Board shall be a resident of or have recently done construction work within the City of Blue Lake or its sphere of influence area at the time of his or her appointment and during his or her incumbency. Members shall serve at the pleasure of the City Council.
A quorum for transacting business shall consist of four of seven members of the Board.
Should a vacancy occur in the Board for any reason, such vacancy shall be filled by the City Council.
When the best interests of the City shall be served thereby, any member of the Board may be removed from office by the City Council.
The Building Official shall be an ex officio member and shall act as secretary of the Board.
The Board shall adopt reasonable rules and regulations for conducting its investigations.
The Board shall render all decisions in writing to the Building Official with a duplicate copy to the appellant.
The Board shall meet as necessary and upon call of the Building Official. Minutes of the meeting shall be made available to the City Council within a reasonable time following each meeting.
Neither the Board, nor any member thereof, nor any person connected therewith shall incur any financial liability in the name of the City of Blue Lake.
