The following procedures shall be followed for the selection
of contractors to perform public projects by informal bidding procedures
pursuant to subdivision (b) of Section 22032 of the Public Contract
Code, to wit:
A. The
City Manager shall maintain a list of all qualified contractors, identified
according to categories of work.
B. All
contractors on the list for the category of work being bid and/or
all construction trade journals specified in Section 22036 of the
Public Contract Code shall be mailed a notice inviting informal bids
unless the product or service is proprietary.
C. All mailing of notices to contractors and construction trade journals pursuant to subsection
B of this section shall be completed not less than 10 calendar days before bids are due.
D. The
notice inviting informal bids shall describe the project in general
terms and how to obtain more detailed information about the project,
and state the time and place for the submission of bids.
E. The
City Council may delegate the authority to award informal contracts
to the City Manager.
F. If all
bids received are in excess of $100,000.00, the City Council may by
passage of a resolution by a four-fifths vote, award the contract,
at $110,000.00, or less, to the lowest responsible bidder, if it determines
the cost estimate of the City was reasonable.
Notice inviting formal bids pursuant to subdivision (c) of Section
22032 of the Public Contract Code shall state the time and place for
the receiving and opening of sealed bids and distinctly describe the
project. The notice shall be published at least 14 calendar days before
the date of opening the bids in the Arcata Eye or the Eureka Times
Standard, as the City Manager deems appropriate, both of which are
newspapers of general circulation which are circulated in the jurisdiction
of the City of Blue Lake, there being no newspaper of general circulation
published within the jurisdiction of the City of Blue Lake. The notice
inviting formal bids shall also be mailed to all construction trade
journals specified in Section 22036 of the Public Contract Code. The
notice shall be mailed at least 30 calendar days before the date of
opening the bids. In addition to the notice required by this section,
the City Manager may give other notice as he or she deems proper.
In its discretion, the City Council may reject any bids presented.
If after the first invitation for bids all bids are rejected, the
City Council shall state the reason for the rejection, and after reevaluating
its cost estimates of the project, the City Council shall have the
option of either of the following:
A. Abandoning
the project or re-advertising for bids in the manner described by
this chapter.
B. By passage
of a resolution by a four-fifths vote of the City Council declaring
that the project can be performed more economically by the employees
of the City of Blue Lake, having the project done by force account
without further complying with Article 3 of Chapter 2 of Part 3 of
the California Public Contract Code (commencing with Section 22030),
or the other sections of this chapter.
If a contract is awarded, it shall be awarded to the lowest
responsible bidder. If two or more bids are the same and the lowest,
the City Council may accept the one it chooses.
