All new utility distribution facilities (including but not limited
to electric, communication and cable-television lines) installed in
and for the purposes of supplying service to single-family residential
subdivisions or developments of five or more dwelling units or to
commercial subdivisions or developments shall be placed underground
with the exceptions of:
A. Poles
or electroliers used exclusively for street lighting; and
B. Equipment
appurtenant to underground facilities, such as surface-mounted transformers,
pedestal-mounted terminal boxes, meter cabinets, and concealed ducts
which may be installed aboveground.

The city council may authorize exceptions to the provision in Section
12.28.210 for poles supporting only high-voltage wires, switches and transformers.

The subdivider or developer is responsible for complying with
the requirements of this section and shall make the necessary arrangements
with the utility companies involved for the installation of said facilities.

The city council may waive the requirements of this chapter
if topographical, soil, or any other conditions make underground installation
of the facilities unreasonable or impractical.

It is unlawful for any person to violate any provision or to
fail to comply with any of the requirements of this chapter. Any person
violating any provision of this chapter or failing to comply with
any of its requirements shall be deemed guilty of infraction.
