A penalty not to exceed one thousand dollars will be assessed to any user for each day that a report required by this chapter or a permit or order issued hereunder is late, beginning five days after the date the report is due.

The pretreatment coordinator may decline to issue or reissue an individual wastewater discharge permit or a general permit to any user who has failed to comply with any provision of this chapter, a previous individual wastewater discharge permit, or a previous general permit or order issued hereunder, or any other Pretreatment Standard or Requirement, unless such user first files a satisfactory bond or a standby letter of credit with the city as contingent payee, in a sum determined by the pretreatment coordinator to be necessary to achieve consistent compliance.

The pretreatment coordinator may decline to issue or reissue an individual wastewater discharge or a general permit to any user who fails or has failed to comply with any provision of this chapter, a previous individual wastewater discharge permit, or a previous general permit or order issued hereunder, or any other Pretreatment Standard or Requirement, unless the user first submits proof that it has obtained insurance or other financial assurances sufficient to restore or repair potential damage to the POTW caused by its discharge.

The pretreatment coordinator may decline to issue or reissue an individual wastewater discharge permit or a general permit to any user who has failed to pay any outstanding fees, fines or penalties incurred as a result of any provision of this chapter, a previous individual wastewater discharge permit, or a previous general permit, or an order issued hereunder.

If a user has violated or continues to violate any provision of this chapter, an individual wastewater discharge permit, a general permit, or an order issued hereunder, or any other Pretreatment Standard or Requirement, water service to the user may be discontinued. Service will recommence, at the user's expense, only after the user has satisfactorily demonstrated its ability to comply.

The city may offer a reward for information leading to the discovery of noncompliance by a user. In the event that the information provided results in a civil penalty or an administrative fine levied against the user, the city may disperse the reward as provided by resolution of the city council.

Users that are not in compliance with applicable Pretreatment Standards and Requirements are not eligible to receive a contractual award for the sale of goods or services to the city.
