The following words, phrases, and designations, whenever used
in this title, unless from the context a different meaning is specifically
defined and more particularly directed to the use of such words, phrases,
or designations, shall have the meanings ascribed to them in this
chapter.

The Federal Water Pollution Control Act, also known as the Clean
Water Act, Pub. L. No. 100-4, 101 Stat 7, codified at 33 U.S.C. Section
1251 et seq., as amended.

An authorized representative of an industrial user may be: (1)
A principal executive officer of at least the level of vice president,
if the industrial user is a corporation; (2) A general partner or
proprietor if the industrial user is a partnership or proprietorship,
respectively; (3) A duly authorized representative of the individual
designated above if such representative is responsible for the overall
operation of the facilities from which the indirect discharge originates.

"Biochemical oxygen demand" means the quantity of dissolved
oxygen utilized in the biochemical oxidation of organic matter under
standard laboratory procedure in five days at twenty degrees Centigrade,
expressed in milligrams per liter.

Pretreatment standards includes national categorical pretreatment
standards, national prohibited discharge standards, and the city's
local limits.

"Chemical oxygen demand" means the equivalent quantity of oxygen
utilized during oxidation of organic and inorganic matter in wastewater
under the conditions of the COD test described in Standard Methods,
expressed in milligrams per liter.

"Chlorine demand" means the amount of chlorine required to produce
a free chlorine residual of 0.1 mg/l after a contact time of fifteen
minutes as measured by iodmetic method of a sample at a temperature
of twenty degrees in conformance with Standard methods.

The city of San Bruno a municipal corporation as incorporated
under the laws of the state of California. The term "city" used in
conjunction with an administrative position title, as in the case
of city manager, city engineer or city clerk, shall be taken to mean
that person employed and assigned by the city of San Bruno to perform
that specific function assigned to him/her by that title.

"Contamination" means an impairment of the quality of the waters
of the state by waste to a degree which creates a hazard to the public
health through poisoning or through the spread of disease.

The water discharged from any use such as air conditioning,
cooling or refrigeration, or to which the only pollutant added is
heat.

The San Mateo County department of environmental services, or
any successor.

The discharge of treated or untreated wastewater directly to
the waters of the state.

"Director" means the public works director of the city or his
or her authorized deputy, agent, or representative.

"Discharger" means any person who discharges or causes the discharge
of wastewater to the city sewer system.

"Domestic" means of or pertaining to single-family, two-family,
or multiple-dwelling units.

The U.S. Environmental Protection Agency, or one of its duly
authorized officials.

"Garbage" means solid wastes from the preparation, cooking,
and dispensing of foods, and from the handling, storage, and sale
of produce. "Properly ground garbage" is the wastes from the preparation,
cooking, and dispensing of foods, which have been ground to such a
degree that all particles may be carried freely under the flow conditions
normally prevailing in public sewers.

A sample which is taken from a waste stream on a one time basis
with no regard to the flow in the waste stream and without consideration
of time.

"Grease" means greases, oils, fats, fatty acids, waxes, soaps,
or other matter which is so determined in accordance with the Standard
Methods examination for grease in polluted waters.

Any waste from holding tanks such as vessels, chemical toilets,
campers, trailers, septic tanks, and vacuum-pump tank trucks.

The discharge or the introduction of nondomestic pollutants
from any source regulated under Section 307(b), (c), or (d) of the
Act, (33 U.S.C. 1317), into the water quality control facilities (including
holding tank waste discharge into the system).

A source of indirect discharge (corresponding definition 40
CFR 403.8).

A discharge which, alone or in conjunction with a discharge
or discharges from other sources, both inhibits or disrupts the POTW,
its treatment processes or operations, or its sludge processes, use
or disposal; and therefore, causes a violation of the POTW's National
Pollutant Discharge Elimination System (NPDES) permit or prevents
sewage sludge use or disposal in compliance with Section 405 of the
Clean Water Act, the Solid Waste Disposal Act (SWDA), the Clean Air
Act, the Toxic Substances Control Act, and the Marine Protection,
Research and Sanctuaries Act.

"Mass emission rates" means pounds per day in waste discharge
of each of the materials designated in Sections 10.16.170 through
10.16.220, inclusive.

Any regulation containing pollutant discharge limits promulgated
by the EPA in accordance with Section 307(b) and (c) of the Act (33
U.S.C. 1317) which applies to the standards specified in 40 CPR Chapter
I, Subchapter N, Parts 405-471.

A permit issued pursuant to Section 402 of the Act (33 U.S.C.
1342).

Any regulation developed under the authority of Section 307
(b) of the Act (33 U.S.C. 1347) and 40 CFR Section 403.5.

"Natural outlet" means any outlet into a watercourse, pond,
ditch, lake, bay, ocean, or other body of surface water, or outlet,
into the groundwater.

Any building, structure, facility or installation from which
there is, or may be, a discharge of pollutants, the construction of
which began after the publication of proposed pretreatment standards
pursuant to Section 307 (c) of the Clean Water Act which will be applicable
to such source if such standards are promulgated, provided certain
location and construction criteria are met.

Discharge through the POTW to navigable waters which, alone
or in conjunction with discharges from other sources, is a cause of
a violation, or an increase in the magnitude or duration of a violation
of the NPDES permit.

Any individual, partnership, copartnership, firm, company, corporation,
association, joint stock company, trust estate, governmental entity
or any other legal entity, or their legal representatives, agents
or assigns. Any person who contributes, causes or permits the contribution
of wastewater into the water quality control plant is a user.

"pH" means the logarithm of the reciprocal of the hydrogen ion
concentration in gram-ions per liter.

Any dredged spoil, solid waste, incinerator residue, sewage,
garbage, sewage sludge, munitions, chemical wastes, biological materials,
radioactive materials heat, wrecked or discharged equipment, rock
sand, cellar dirt, industrial, municipal or agricultural waste discharged
into water.

"Polluted" means containing or bearing any poisonous, degrading,
or deleterious material or such material at a harmful temperature,
or any other material at a harmful temperature.

"Pollution" means an alteration of the quality of the waters
of the state by waste to a degree which unreasonably affects such
waters for beneficial use or facilities which serve such beneficial
uses. Pollution may include contamination.

"Premises" means any place, lot, piece or parcel of land, whether
enclosed or unenclosed, occupied by or in any way devoted to the maintenance
of any boardinghouse, eating house, lodging house, restaurant, hotel,
hospital, store, apartment house, dwelling house or flat, and any
stable, stall, shed, pen, yard, area or enclosure in any way devoted
to the keeping of fowl, livestock, or other animals.

The reduction of the amount of pollutants, the elimination of
pollutants, or the alteration of the nature of pollutant properties
in wastewater to a less harmful state prior to or in lieu of discharging
or otherwise introducing such pollutants into the wastewater treatment
system. The reduction or alteration can be obtained by physical, chemical
or biological processes, or process changes by the other means, except
as prohibited by 40 CFR Section 403.6(d).

A program to protect the water quality control facilities, its
workers and the environment from adverse impacts that may occur when
hazardous or toxic wastes are discharged into the sewage system.

"Pretreatment requirements" means any substantive or procedural
requirement related to pretreatment, other than a National Pretreatment
Standard, imposed on an industrial user.

A treatment works as defined by Section 212 of the Act (33 U.S.C.
1292) which is owned in this instance by the cities of South San Francisco
and San Bruno.

"Residential premises" means a single, duplex, or multiple dwelling
unit and can be used interchangeably with domestic premises.

"Rubbish" means all refuse materials and substances of every
kind and character other than garbage including paper, cardboard containers,
boxes, rags, leaves, grass, vines, sawdust, sweepings, plaster, brick
cement, glass, crockery, shells, metals, metal products, cans, ashes
and tree trimmings.

"Sanitary sewage" means domestic or residential sewage.

"Sewage" means water-carried and liquid wastes from residences,
business, buildings, institutions, and industrial establishments,
together with such ground, surface, and storage waters as may be present,
or any combination of such wastes and waters.

"Sewage facilities" means that arrangement of devices and structures
used for the transportation, treatment, and disposal of sewage, including
but not limited to intercepting sewers, sewage treatment works, pumping
plants, outfill sewers, and appurtenances constructed, operated and
maintained by the city for sewage disposal purposes.

"Sewer" means a pipe or conduit for carrying water, sewage,
and/or wastewater.
A. "Public
sewer" means a sewer which is controlled by the city or other agency.
B. "Sanitary
sewer" means a sewer for domestic, commercial and industrial waste
to which storm, surface, and ground waters are not intentionally admitted.
C. "Side
sewer" means a sewer conveying the wastewater of a discharge from
a residence, building or other structure and from the premises of
the user to a public sewer, including direct connections where permitted.
D. "Storm
sewer" means a sewer which carries storm and surface waters to San
Francisco Bay; but from which sewage and polluted industrial, commercial
and institutional wastes are required to be excluded.

A. All
categorical industrial users (see National Categorical Pretreatment
Standard).
B. Any
noncategorical industrial user that:
1. Discharges
twenty-five thousand gallons or more per day of process wastewater,
or
2. Contributes
a process wastestream which makes up five percent or more of the average
dry weather hydraulic or organic capacity of the treatment plant,
or
3. Has
a reasonable potential, in the opinion of the city, to adversely affect
the POTW (i.e., inhibition, pass through of pollutants, sludge contamination,
or endangerment of POTW and collection system workers).

The designated representative of the superintendent assigned to monitor and enforce the provisions of Chapter
10.16 of this code, within the city.

A classification pursuant to the Standard Industrial Classification
Manual issued by the Executive Office of the President, Office of
Management and Budget, 1972, or any successor.

"Standard Methods" means the latest United States Environmental
Protection Agency approved edition of Standard Methods for the Examination
of Water and Wastewater prepared and published jointly by American
Public Health Association, American Water Works Association, and the
Water Pollution Control Federation on methods deemed equivalent by
the Superintendent and the Water Quality Control Board for the San
Francisco Bay Region, herein referred to for definitions, laboratory
procedures of analysis, tests (including test samples) and measurements.

"Superintendent" means the superintendent of sanitation of the
sewage treatment plant (which is also called the waste quality control
plant), or his or her authorized deputy, agent, or representative.

Any flow occurring during or following any form of natural precipitation
and resulting therefrom.

"Suspended solids" means solids that either float on the surface
of, or are in suspension in, water, sewage, or other liquids, and
which are removable by laboratory filtering.

"System" shall refer to the combined facilities utilized by
the city of San Bruno or pipes, junction structures, transmission
facilities, pumps, motors and related civil, electrical and mechanical
facilities utilized to transport sewerage and those civil, electrical
and mechanical facilities utilized by the city of San Bruno to pretreat,
treat, process and dispose of all sewerage in the form of effluents,
gaseous emissions and sludges. The collection system means that portion
of the system which has as its purpose the collection, transmission
and pumping of sewerage. The treatment system means that portion of
the system which has as its purpose the pretreatment, treatment, processing
and disposal of sewerage and its by-products. The term municipal wastewater
system shall have the same meaning as system and is used for compliance
with federal and state terminologies. The term water quality control
plant shall have the same meaning as treatment system.

Any pollutant or combination of pollutants listed as toxic in
regulations promulgated by the Administrator of the Environmental
Protection Agency under the provision of Section 307(a) of the Act
(33 U.S.C. 1317) or other acts.

An incident in which one or more pollutants cause the removal
efficiency for a treatment process at the POTW to be dramatically
reduced.

"Waste" means sewage and any and all other waste substances,
liquid, solids, gaseous, or radioactive, associated with human habitation,
or of human or animal origin, or from any producing, manufacturing,
personal service industry, or processing operation of whatever nature.

"Wastewater" means sewage, industrial and other wastes, liquids,
whether treated or untreated, discharged into or permitted to enter
the public sewage system.

All streams, lakes, ponds, marshes, watercourses, waterways,
wells, springs, reservoirs, aquifers, irrigation systems, drainage
systems and all other bodies or accumulations of water, surface or
underground, natural or artificial, public or private, which are contained
within, flow through, or border upon the state or any portion thereof.

A wastewater treatment works as defined by Section 212 of the
Act (33 U.S.C. 1292), which is partially owned by the city. This definition
includes any sewers that convey wastewater to the water quality control
plant, but does not include pipes, sewer or other conveyances not
connected to a facility providing treatment. For the purposes of this
chapter, water quality control facilities shall also include any sewers
that convey wastewaters to the plant from persons outside the city
who are, by contract or agreement with the city, users of the city's
water quality control facilities. The portion of the facilities designed
to provide treatment to wastewater is the water quality control plant.

A treatment works as defined by Section 212 of the Act (33 U.S.C.
1292) as this definition applies to the water quality control plant
jointly owned by the cities of South San Francisco and San Bruno.
This definition includes those facilities utilized to provide primary,
secondary, applicable tertiary treatment of sewage, chlorination and
dechlorination of the sewerage stream flow, and treated sewerage discharge
facilities. The water quality control plant shall also specifically
include, by reference hereto, the Shaw Road Pump Station, the San
Mateo Avenue Pump Station and those pipelines and appurtenant facilities
utilized to transport sewerage flows from these pump stations to the
publicly owned treatment works.
