For the purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
"Infectious disease"
shall mean a disease that is capable of spreading to others through the transfer of bodily fluids.
"Open sore"
shall mean a sore that is capable of transmitting bodily fluids into the waters of the water play area.
"Park"
shall mean a piece of land owned or operated by the city of Lathrop, which is improved and designated as a park open for public recreation purposes.
"Unemancipated"
shall mean legally still under parental custody or guardianship.
"Water play area"
shall mean an area within 10 feet of any water jet (in ground or otherwise) that is located in a park that is intended for recreational usage.

The season and hours for any water play area in a park shall be determined and modified at the discretion of the director of parks and recreation. The director of parks and recreation shall have the authority to shut down the water play area during the determined season and hours for any reason deemed necessary.

Except as otherwise authorized by law, it shall be unlawful and an infraction for any person to do or cause or permit to be done any acts hereinafter specified within any water play area located in a park:
A. 
For a child that is not toilet trained to use the water play area without wearing a swim diaper;
B. 
For a child under the age of 12 to use the water play area without supervision from a parent and/or caregiver over the age of 16;
C. 
To use the water play area without practicing good hygiene. For example: to shower before using the water play area and to wash hands after using the restroom or changing diapers;
D. 
To enter the water play area with an infection disease or open sore;
E. 
To bathe or wash clothes in the water play area;
F. 
To "smoke" (as defined in Section 12.30.020 of this code) within 25 feet of the water play area;
G. 
To run, push or rough play in the water play area;
H. 
To use or operate a "coasting device" (as defined in Section 12.24.010 of this code) in the water play area;
I. 
To bring into any water play area the following items: glass containers, cleaning or other chemical substances (other than those approved for use by the parks maintenance staff) and animals.

All provisions of the parks rules found in Chapter 12.20 of this code shall apply to this facility.

A. 
The remedies provided in this chapter are cumulative and in addition to any other remedies available in law or in equity.
B. 
Causing, permitting, aiding, abetting or concealing a violation of any provisions of this chapter shall also constitute a violation.
C. 
Violations of this chapter shall be prosecuted as an infraction and shall be punished as set forth in Section 1.16.010 of this code.
D. 
Any parent or legal guardian having control or custody of an unemancipated minor whose conduct violates this chapter, shall be jointly and severally liable with the minor for any fines imposed pursuant to this chapter.
