It shall be unlawful for any person, either as principal, agent, employee or otherwise to keep, conduct or maintain within the City of Mill Valley, any house, room, apartment or place used in whole or in part as a place where any game not mentioned in Section 330 of the Penal Code of the State of California is played, conducted, dealt or carried on, with cards, dice, billiard balls, pool balls, cues, or other device, for money, checks, chips, credit or any other representative of value or for any merchandise or any other thing of value.

It shall be unlawful for any person, within the City, to play or bet at or against any game not mentioned in Section 330 of the Penal Code of the State of California which is played, conducted, dealt or carried on with cards, dice, billiard balls, pool balls, cues or other device, for money, checks, chips, credit or any other representative of value or for any merchandise or any other thing of value at any house, room, apartment or place kept, conducted, or maintained, and used in whole or in part, as the place where any such game is played, conducted, dealt or carried on.

The provisions of this chapter shall not be construed so as to prohibit games of dice played for merchandise only at or in any regularly established place of business maintained for the sale of such merchandise, nor shall the provisions of this chapter be construed so as to prohibit games of bingo conducted pursuant to the limitations contained in Section 19 of Article 4 of the California State Constitution, Section 326.5 of the California Penal Code, and all laws and regulations of the City. Such bingo games may be lawfully conducted within the City of Mill Valley by any organization exempted from the payment of the Bank and Corporation tax by Sections 23701(a), 23701(b), 23701(d), 23701(e), 23701(f), 23701(g), and 23701(l) of the Revenue and Taxation Code of the State of California and by mobile home park associations and senior citizens' organizations, provided that the proceeds of such games are used only for charitable purposes.
Any such organization conducting bingo games shall, upon request of the City of Mill Valley, permit the City of Mill Valley to audit its records for the purpose of determining whether the conduct of such bingo games complies with the foregoing provisions of law.
