No person shall engage in, carry on, maintain or conduct a poolroom or billiard room in the city without first having applied for and secured a license pursuant to Chapter 5.16, paid license taxes as specified in Chapters 5.04 and 5.08, and complied with all regulations pertaining to such business provided in this code.

No proprietor, manager, or agent of such proprietor of any poolroom or billiard room shall permit any person under the age of twenty-one years to remain in any such licensed pool or billiard room where any alcoholic or intoxicating liquors of any kind or character are served or consumed in the premises used for such a poolroom or billiard room.
No person under the age of twenty-one years shall be or remain in any licensed poolroom or billiard room to witness any game of pool or billiards or other games played therein where alcoholic or intoxicating liquors of any kind or character are served or consumed in the premises used for such a poolroom or billiard room.

No proprietor, manager or agent of such proprietor shall permit any gambling of any kind or character to be carried on in a licensed poolroom or billiard room or permit any betting or wagering to take place or occur therein upon any game of pool or billiards or other game played in such licensed poolroom or billiard room.
Nothing in this section shall be construed to prevent any two or more persons from deciding by the result of the game of pool or billiards played by them who shall pay the fee or amount charged by the proprietor for the use of the pool or billiard table at which persons play.

In any poolroom or billiard room where alcoholic or intoxicating liquors or beverages are not served or consumed in the premises, the proprietor, manager or other person in charge of any such poolroom or billiard room shall not admit any person under the age of sixteen years, unless the person under the age of sixteen years is accompanied by and under the supervision and control of his parent or legal guardian.
However, notwithstanding the above, a person having a valid license under this chapter may apply under Chapter 17.70 of the zoning ordinance for a conditional use permit allowing persons under the age of sixteen years to be present in a poolroom or billiard room and to engage in or play pool or billiards in such premises where no alcoholic or intoxicating liquors or beverages are served or consumed.

In any poolroom or billiard room where alcoholic or intoxicating liquors or beverages are not served or consumed in the premises, no person under the age of sixteen years shall be or remain in such licensed premises to witness any game of pool or billiards or other games played therein unless accompanied by and under the supervision and control of his parent or legal guardian.

The provisions of this chapter shall not apply either to any private family keeping one pool or billiard table exclusively for family use or to any public or nonprofit agency, including, but not limited to, the boys' club of the city, and schools and recreation departments where the playing of pool is controlled and supervised by authorized employees of the public, charitable or nonprofit agencies.

Any business which is established or maintained in violation of this chapter is deemed to be a public nuisance and may be abated in accordance with Chapter 1.16 of this code.
