No person shall use or occupy any part of a public sidewalk, street or alley for any purpose other than normal pedestrian or vehicular traffic, except as otherwise provided by law or by resolution of the city council.

No person, after first being warned by an owner, operator or agent, or by a law enforcement officer, shall intentionally loiter or stand in or upon any public or quasi-public sidewalk, street, curb, crosswalk, walkway area, mall or that portion of private property held open to the public, or alley, or other public way open for pedestrian travel, or otherwise occupy, bodily or with animals and/or possessions, any portion thereof in such a manner as to maliciously obstruct or interfere with the free passage of pedestrians or vehicles; nor shall any person, bodily or with animals and/or possessions, block or obstruct, or prevent the free access to the entrance to any building open to the public.
This section shall not apply to peaceful picketing, public speaking or other lawful expressions of opinion not in contravention of other laws.

The use of a public sidewalk, street or alley may be permitted, with approval of the public works department, when the use is in conjunction with building construction for which a building permit has been secured, and conformity with all sections of Chapter 44, Uniform Building Code, have been met.

Nothing contained in this chapter shall prohibit the sale, offering for sale, or custody or possession for sale of newspapers, magazines, periodicals or other printed matter, occurring upon the public rights-of-way and not upon any roadway (as defined in Section 12.10.020); provided, that when a newsrack (as defined in Section 12.10.020) is used for such purpose, it shall conform to the requirements of Chapter 12.10 of this code.

Nothing contained in this chapter shall prohibit the sale or offering for sale of programs or similar brochures detailing or listing any nonprofit group or corporation or its agents, servants or employees, upon public sidewalks, and also upon public streets, when such streets are closed to normal vehicular traffic by proper authority for the purpose of a parade or entertainment; provided, that such activity shall not unreasonably obstruct the normal and necessary public use of such sidewalk or street.

Nothing contained in this chapter shall prohibit the right of any person to load or unload goods, wares and merchandise in front of the place of business of such person and to leave such goods, wares and merchandise upon such sidewalk or curb for such length of time as is necessary for the purpose of loading or unloading the same.
