The California Existing Building Code, 2025 Edition, including appendix chapters A1, A2, A3, and A4, but excluding section 103, and appendix chapter B, as published by the International Code Council, is adopted by reference as the existing building code of the city (the "existing building code"), except as hereinafter modified, amended, repealed or deleted, for regulating the construction, erection, enlargement, repair, removal, demolition, occupancy, equipment, use, height, area and maintenance of all buildings and structures in the city, when rebuilding or reconstructing a building or structure damaged by emergencies created by seismic activities, winds, floods, conflagrations, or other such disasters, or for retrofitting of existing buildings for soft story or unreinforced masonry construction, and is by this reference made a part hereof as though fully set out herein. The California Existing Building Code, 2025 Edition, is referred to in this chapter as the "CEBC," and one copy is on file in the office of the city clerk.

Section 112 of the CEBC is amended to read as follows:
112. Board of Appeals. Appeals to the decisions or determinations made by the building official relative to the application and interpretation of the California Existing Building Code adopted by the city, shall be heard in accordance with the board of appeals procedure as outlined in the California Building Code as amended by Chapter 15.04 of the El Cajon Municipal Code.

This chapter shall not be construed to relieve from or lessen the responsibility of any party owning, operating, controlling or installing any electrical wiring, electrical device or electrical materials for damage to person or property caused by any defect therein, nor shall the City or any officer or employee thereof enforcing this code be held as assuming any such liability by reason of the inspections authorized within the provisions of this chapter.

A violation of any provision of the CEBC as adopted and amended by this chapter is deemed to be a public nuisance and may be abated in accordance with Chapter 1.16 of this code.

Any person, firm or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and subject to the provisions of the general penalty clause as set forth in Section 1.24.010 of this code, or any other penalty adopted by the City.
