The 2018 edition of the International Fire Code is hereby adopted and incorporated in full, save and except such portions as are herein amended, deleted or added by section 5.04.009, and shall be in force from the effective date of this article and shall be controlling within the areas of jurisdiction of the city.

(a) 
Whenever the word "jurisdiction" is used in the International Fire Code, 2018 edition, it shall be held to mean the corporate limits of the City of Pecan Hill, Texas.
(b) 
Whenever the phrase "corporate counsel" is used in the International Fire Code, 2018 edition, they shall be held to mean the city attorney for the City of Pecan Hill, Texas.
(c) 
Whenever the phrase "chief of the bureau of fire prevention" or word "chief" are used in this article and the International Fire Code, 2018 edition, it shall be held to mean the fire chief or other lead authority of fire rescue services serving the City of Pecan Hill.
(d) 
Whenever the phrase "bureau of fire prevention" is used in this article and the International Fire Code, 2018 edition, it shall be held to mean the fire rescue services serving the City of Pecan Hill.
(e) 
Whenever the word "city" is used in the International Fire Code, 2018 edition, it shall be held to mean the City of Pecan Hill.
(f) 
Whenever the words "police chief" are used in the International Fire Code, 2018 edition, they shall be held to mean the marshal or head law enforcement officer of the City of Pecan Hill.
(g) 
Whenever the words "building official" are used in the International Fire Code, 2018 edition, they shall be held to mean the city's marshal or other designated building official of the City of Pecan Hill.
(h) 
Whenever the words "fleet vehicle" are used in the International Fire Code, 2018 edition, they shall be held to mean a motor vehicle which is one of a group of motor vehicles, owned or operated as a unit and used in the ongoing course of business.

(a) 
The 2018 edition of the International Fire Code shall be enforced by the bureau of fire prevention in the fire department serving the city, which is hereby established, and which shall be operated under the supervision of the chief of the fire department.
(b) 
The fire marshal in charge of the bureau of fire prevention shall be appointed by the chief of the fire department.

The limits referred to in section 5704 of the 2018 edition of the International Fire Code in which storage of flammable or combustible liquids in outside above-ground tanks is prohibited are hereby established as follows: Any area within the city limits unless a permit therefor has been issued by the bureau of fire prevention.

The limits referred to in section 6109 of the 2018 edition of the International Fire Code in which the bulk storage of liquefied petroleum gas is restricted are hereby established as follows: Any area within the city limits unless a permit therefor has been issued by the bureau of fire prevention.

The limits referred to in section 5604 of the 2018 edition of the International Fire Code in which storage of explosives and blasting agents is prohibited are hereby established as follows: Any area within the city limits unless a permit therefor has been issued by the bureau of fire prevention.

Whenever the fire marshal shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the code adopted by this article do not apply or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the fire marshal to the office of the fire chief within thirty (30) days from the date of the decision appealed.

The fire chief and the fire marshal shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies which shall require permits, in addition to those now enumerated in the code adopted by this article. The fire marshal of the division of fire prevention shall post such list in a conspicuous place in his office and distribute copies thereof to interested persons.

(a) 
Any person, firm, partnership, association or corporation who shall violate any of the provisions of this article shall be guilty of a misdemeanor, and upon conviction thereof, such violation shall be punishable by a fine in an amount not to exceed two thousand dollars ($2,000.00). Each and every instance of the violation of this article constitutes a separate offense and shall be punishable by separate fines for each offense.
(b) 
Nothing is this article shall preclude the city's pursuit of any and all other remedies allowed under the civil and criminal statutes of the state, and in equity, including, but not necessarily limited to, chapter 54, subchapter B, of the Texas Local Government Code, to prosecute civil suits for enforcement, injunctive relief, and civil penalties. Neither shall the city be required, nor prohibited, to issue criminal citations before, after, or during any proceeding prescribed in this article.
