There is hereby established a Recreation and Community Services Commission for the City.

The Recreation and Community Services Commission shall consist of five members who shall be qualified electors of the City. The term of each member shall be four years. The terms heretofore established for the Park and Recreation
Commission shall remain in effect, and the members of said Commission shall continue in office until the expiration of their respective terms. If vacancies shall occur, otherwise than by expiration of term, they shall be filled by appointment for the unexpired portion of the term. Members shall be appointed by the Council, one from each Councilmanic district. Members of the Commission shall serve without compensation.

If a member of the Recreation and Community Services Commission shall be absent from three successive regular meetings of the Commission without cause, the office of such member shall be deemed to be vacant and the term of such member terminated, and the Recreation and Community Services Commission shall immediately inform the Council of such vacancy.

An absence due to illness or an unavoidable absence from the City and written notice thereof to the Recreation and Community Services Commission on or before the day of any regular meeting of the Commission shall be deemed absence for cause, and such absence shall be excused.

A regular meeting as provided for by law or by rule of the Recreation and Community Services Commission or any regularly advertised public hearing shall be deemed a regular meeting. The Recreation and Community Services Commission shall hold at least one regular meeting in each month.

The Recreation and Community Services Commission shall elect its chairperson and vice-chairperson from among its appointed members for a term of one year. It shall adopt rules for the transaction of business and shall keep a record of the resolutions, transactions, findings, and determinations, which record shall be a public record.

Members of the Recreation and Community Services Commission may be removed, upon good cause, by a majority vote of the Council.

The Recreation and Community Services Commission shall be responsible for advising the Council and recommending to the Council the policies concerning the administration of the Department of Parks and Recreation. The Commission shall:
(a) 
Recommend to the Council rules and regulations for the efficient administration of the Department of Parks and Recreation. Any such rules and regulations so recommended and adopted by the Council shall govern the use and regulation of such parks; and
(b) 
Recommend to the Council such plans and programs as may be desirable for the improvement, maintenance, and expansion of parks and playgrounds as are or may hereafter be established.

There is hereby created the office of Park and Recreation Director. Appointments to this office shall be made by the City Manager pursuant to the provisions of Section 604 of the Charter.

The Park and Recreation Director shall be the administrative head of the Department of Parks and Recreation. He or she shall:
(a) 
Be responsible, as a department head, to the City Manager for the efficient operation of his or her department;
(b) 
Supervise and control all persons employed in the Department of Parks and Recreation; and
(c) 
Prepare and submit to the Recreation and Community Services Commission tentative budgets for his or her department and, upon the approval of the Commission, shall submit the same to the City Manager.

A Department of Parks and Recreation for the City is hereby established, and the Park and Recreation Director shall be the head of such department.

All moneys collected, assessed, or otherwise obtained for park and recreation purposes shall be used for those purposes exclusively.
