A. 
Intent and Purpose. The city council has ordained the provisions of this title in order to promote the:
1. 
Public health, safety and general welfare;
2. 
Orderly growth and development of the city in harmony with the physical aspects of the city as already laid out or as planned;
3. 
Proper use of land;
4. 
Conservation, stabilization and protection of the value of the property;
5. 
Adequate provisions for necessary utilities and convenience.
B. 
Citation and Authority.
1. 
Citation. The ordinance codified in this title is adopted to supplement and implement the Subdivision Map Act and may be cited as the "Subdivision Title of the Upland Municipal Code."
2. 
Authority. The council assumes control of the design and improvement of land subdivision including any division of land created by a parcel map as such is vested in the city by the provisions of the Subdivision Map Act of the state of California, and amendments thereto, or as otherwise established and set forth in this title.
3. 
Deviations from Literal Compliance. It is recognized that situations may arise wherein it may prove to be impractical or impossible or unfair or oppressive to the owner or subdivider to require literal compliance with all of the requirements of this title for approval of a subdivision map or parcel map, and that a certain flexibility is necessary. It is accordingly specifically provided that if the planning commission determines that any of the provisions of this title should be modified or omitted, thereupon the planning commission and city council is authorized and empowered to deviate from the full requirements of this title for approval of a subdivision map or parcel map, and authorize other modifications as the conditions may warrant.

A. 
Whenever any words or phrases used in this title are not defined herein but are defined in the Subdivision Map Act, as last amended, such definitions are incorporated herein and shall be deemed to apply as though set forth in this title.
B. 
"Unit of land" means any plot of land separately described as shown on either:
1. 
The tax assessor's map record on tax rolls as a separate unit of land on the nineteenth day of October, 1950; or
2. 
The official records of the county recorder accomplished by either a subdivision map or other city council approved division of land.
