A. 
To exercise jurisdiction over the construction and inspection of new dwellings in regard to energy conservation.
B. 
To provide on-site inspection performed by persons certified by Department of Safety and Professional Services (DSPS).
C. 
To establish and collect fees to defray cost; and
D. 
To provide remedies and penalties for violations.
Chapter 180, Article III, of the City Code is hereby created to read as follows: Ch. SPS 322, Wis. Adm. Code, "Energy Conservation," a chapter of the Uniform Dwelling Code, as originally adopted and effective December 1, 1978, and all amendments thereto, is adopted and incorporated in this Code by reference.
A. 
The Building Code Department of the City shall be created by the Mayor. The administrative authority shall be a state certified building inspector so designated by the appointing authority subject to confirmation.
B. 
The appointing authority shall be the Mayor of the City subject to confirmation by the Common Council.
There is hereby created the position of Building Inspector who shall administer and enforce this article (Energy Conservation Code) who shall be certified by the Department of Safety and Professional Services as specified by § 101.66(2), Wis. Stats. This appointment is subject to confirmation by the Common Council.
No person shall build or cause to be built any one- or two-family dwelling without first obtaining a building permit for such dwelling. Such building permit shall be of the form prescribed and furnished by the City. A copy of each permit issued shall be filed with the Building Inspector.

The Council shall provide for the enforcement of this article and all other laws and ordinances relating to buildings by means of the withholding of building permits, imposition of forfeitures and injunctive action. Any person violating this article shall be subject to a penalty as provided in § 1-5 of this Code, including injunctive relief in accordance with § 62.23(9), Wis. Stats.
If any section, clause, provision or portion of this article or Ch. SPS 322, Wis. Adm. Code, is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions shall not be affected thereby.
