On the transition date, the animal control functions of the department of environmental health are transferred to the sheriff's department.

The animal control functions of the department of environmental health, which are transferred to the sheriff's department, are as follows:
A. 
Administration and enforcement of the provisions of Title 8 of the Inyo County Code;
B. 
Administration and enforcement of any applicable law of the state relating to the care, treatment, and impounding of animals;
C. 
Any other function provided for county animal control officers by the state; and
D. 
All other related duties and functions as determined by the county.

On the transition date, all assets of the environmental health department which were primarily devoted to the performance of animal control functions, shall become assets of the sheriff's department.

On the transition date, all employees of the environmental health department who are primarily devoted to the performance of animal control functions shall become employees of the sheriff's department at their existing or equivalent classifications, and at their existing salaries and benefits that include accrued and unused vacation, sick leave, flex time, health and pension plans. Further, employment seniority of an employee of the environmental health department on the transition date shall be counted towards seniority in the sheriff's department and all time spent in the same, equivalent, or higher classification shall be counted toward classification seniority.

The transition date shall be July 1, 2004. On the transition date, the animal control functions of the environmental health department are transferred to the sheriff's department, and the assets, personnel, and responsibilities of animal control functions are transferred to the sheriff's department as provided by this chapter.
