The following words, when used in this Chapter shall have the meanings ascribed to them in this Part, except in those instances where the context clearly indicates otherwise:
PERSON
Any natural person, partnership, firm, association or corporation.
ROAD
Any public street, road, highway or other public place located in the Township of Richland and maintained by the Board of Supervisors of Richland Township and established for the use of vehicles.

No person shall construct a driveway opening onto a public road of the Township of Richland unless such person shall first obtain a permit therefore as hereinafter provided.

Any person who proposes to open a driveway onto a public road of the Township of Richland shall make application to the Township for such purpose setting forth the exact location of the proposed driveway opening, the dimensions thereof and the type of construction, and shall, at the same time, tender the appropriate application fee.

In the event the Township shall determine that a driveway pipe is required to facilitate the flow of stormwater across any proposed driveway, it shall be so noted upon the driveway permit; and no person shall install or open any driveway unless a permit for said driveway pipe shall have first been obtained.

Any person who proposes to install a driveway pipe shall make application to the Township for such purpose setting forth the exact location of the proposed pipe. The permit shall set forth specifications, line and grade of said pipe as established by the Township and no person shall install any driveway pipe except in accordance with said specifications, line and grade.

If any owner of a private driveway shall fail to construct or install a driveway pipe, or shall fail or refuse to comply with the conditions of any permit therefore, the Township of Richland shall construct or repair the said driveway pipe and charge the cost to the owner of the driveway along with any additional penalty authorized by law.

The cost of any such construction or repair done by the Township of Richland shall be a lien upon the premises from the time of commencement of the work. Any such lien may be collected by an action of assumpsit or by lien filed in the manner provided by law for the filing and collection of municipal claims.

Any person, firm or corporation who shall violate any provision of the Part, upon conviction thereof in an action brought before a District Justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.

Fees for the permits authorized shall be as set from time to time by resolution of the Board of Supervisors.
