The office of city manager is created and established. The city council shall appoint an officer, selected on the basis of administrative and executive ability, who shall be called city manager and who shall hold office at and during the pleasure of the city council.

To perform his or her duties during his or her temporary absence or disability, the city manager may designate, by letter filed with the city clerk, a qualified administrative officer of the city. In the event of failure of the city manager to make such designation, the city council may, by resolution, appoint an officer of the city to perform the duties of the city manager until he or she returns or his or her disability ceases.

A. 
The city manager shall receive such compensation as the city council shall from time to time determine and fix by resolution, and the compensation shall be a proper charge against such funds of the city as the city council shall designate.
B. 
The city manager shall be reimbursed for all sums necessarily incurred or paid by him or her in the performance of his or her duties or incurred when traveling on business pertaining to the city under the direction of the city council; reimbursement shall only be made, however, when a verified itemized claim, setting forth the sums expended for such business for which reimbursement is requested has been presented to the city council for approval and has been so approved.

A. 
The city council shall appoint the city manager for an indefinite term and may remove him or her by a majority vote of the council. The city council, in removing the city manager, shall use its discretion and its action shall be final.
B. 
The city manager shall not be removed from office during or within a period of ninety days next succeeding any general municipal election held in the city at which election a member of the city council is elected.

The city manager shall be the administrative head of the government of the city under the direction and control of the city council, except as otherwise provided in this chapter. In addition to his or her general powers as administrative head, and not as a limitation thereon, it shall be his or her duty and he or she shall have the powers set forth as follows:
A. 
To see that all laws and ordinances of the city are duly enforced, and that all franchises, permits, licenses and privileges granted by the city are faithfully performed and observed;
B. 
To control and give directions to all heads of departments, subordinate officers and employees of the city, except the city clerk, city treasurer and city attorney; to transfer employees from one department to another; to consolidate or combine offices, positions, departments or units under his or her direction; provided, however, that nothing in this subsection shall be construed to supersede the personnel policy of the city;
C. 
To appoint, promote, demote and remove any officers and employees of the city subject to the provisions of the personnel policy of the city and the limitations as shown in the annual city budget;
D. 
To attend all the meetings of the city council unless excused therefrom by the council;
E. 
To recommend to the city council for adoption such measures and ordinances as he or she deems necessary or expedient;
F. 
To keep the city council at all times fully advised as to the financial conditions and needs of the city;
G. 
To prepare and submit the proposed annual budget and the proposed annual salary plan to the city council for its approval;
H. 
To purchase all supplies for all the departments or divisions of the city in accordance with the ordinances governing same. All expenditures shall be submitted to the city council on report of the city manager. Attempts to influence purchase of supplies or equipment by any member of the council shall be prohibited;
I. 
To make investigations into the affairs of the city and any department or division thereof;
J. 
To exercise general supervision over all public buildings, public parks, and all other public property which are under the control and jurisdiction of the city council;
K. 
To perform such other duties and exercise such other powers as may be delegated to him or her from time to time by ordinance or resolution or other action of the city council;
L. 
To make and keep up to date, an inventory of all property, real and personal, owned by the city and to recommend to the city council the purchase of new machinery, equipment and supplies whenever in his or her judgment the same can be obtained at the best advantage, taking into consideration trade-in value of machinery, equipment, etc., in use;
M. 
To receive and open all mail addressed to the city council and give immediate attention thereto to the end that all administrative business referred to in the communications and not necessarily requiring councilmanic action, may be disposed of between council meetings, providing that all actions taken pursuant to such communications shall be reported to the city council at its next regular meeting thereafter.

Department heads and other designated personnel shall comprise the city staff and shall assist the city manager in the administration of the various functions the city performs.

The city manager shall consider and make recommendations to the city council regarding the extent to which the city shall contract for the performance of technical services by any qualified person or public or private agency.

The city manager shall devote his or her entire time to the duties of his or her office in the interest of the city.

A. 
The city council and its members shall deal with the administrative services of the city only through the city manager, except for the purpose of inquiry and information, and neither the city council nor any member thereof shall give orders to any subordinates of the city manager. No member of the city council shall demand the appointment or removal of any person by the city manager. There is retained to the city council the sole power of being the policy-making and legislative body of the city, and the duties and powers of the city manager are expressly confined to the administrative services of the city under ordinances, resolutions or motions of the council, or under state law.
B. 
The city manager may attend any and all meetings of any commissions or boards heretofore and hereafter created by the city council. At any such meetings which the city manager attends, he or she shall be heard by such commissions and boards as to all matters upon which he or she wishes to address them.

It shall be the duty of all subordinate officers, including the city clerk, city treasurer and the city attorney, to cooperate with and assist the city manager in administering the affairs of the city most efficiently, economically and harmoniously so far as may be consistent with their duties as prescribed by law and ordinances of the city.

The city manager is prohibited from engaging in political activity during working hours and is further prohibited from engaging in political activity on the premises of city facilities.

Nothing in this chapter shall be construed as a limitation on the power or authority of the city council to enter into any supplemental agreement with the city manager delineating additional terms and conditions of employment not inconsistent with any provisions of this code.
