1. An improvement construction plan shall be required whenever any improvement is to be constructed or installed. The plan shall provide sufficient information for Borough review of the typical cross-section of the streets and horizontal and vertical details of all streets, drainage facilities, sanitary sewers, water mains, fire hydrants, streetlights, underground and aboveground utility conduits and poles as specified in Part
8, § 805, Subsection 1E. The plan shall also provide sufficient information for Borough review of all the required improvements which are set forth in Part
6 hereof.
2. Purpose. The purpose of the improvement construction plan is to provide
sufficient information for the laying out and construction of the
proposed improvements.
3. Procedure.
A. The required number of copies of the preliminary and final improvement
construction plan shall be submitted simultaneously with the submission
of the preliminary and final site plans to the Borough Secretary.
The Borough Secretary shall distribute copies of the preliminary and
final improvement construction plans to the applicable Borough, county,
state, and federal agencies with a request for preliminary and final
review and comment, where applicable.
B. Procedure for approval of preliminary and final improvement construction
plans shall be in accordance with the procedure outlined for review
of preliminary site plans in § 405.
C. No sanitary sewer, sewage pumping station, sewage treatment plant
or drainage facility shall be constructed or no earth moving activity
shall be permitted until the permits, as required by law, have been
obtained from the Pennsylvania Department of Environmental Resources.
D. After approval by Borough Council, the improvement construction plan
shall be submitted in conjunction with the positive prints of the
recorded plan, in quadruplicate on paper, to the Borough Secretary.
E. If the improvements have been commenced and there has been no construction
performed for a period of six months, Borough Council shall require
that, prior to any further construction, the plan shall be resubmitted
and it may require changes and modifications to the plan. No building
permits will be issued; work on issued building permits will terminate;
and no permit issued for continuation of construction improvement
until such changes and modifications, if necessary, as ordered by
Borough Council, have been incorporated into the plan and, when required,
additional surety posted to guarantee completion of the improvements,
provided that an extension of six months may be granted by Borough
Council upon written request therefor.
4. Time Limit for Construction. All construction improvements must be
completed within two years from the date of recording of the final
improvement construction plan.

1. General. Following approval of any subdivision or land development plan, the plan shall be recorded by the applicant in accordance with Part
8, § 806, of this chapter. If the plan is not recorded within the 90 days from the date of approval, the approval shall lapse and become void. Borough Council may extend the ninety-day period upon written application by the applicant.
2. Effect of Recording.
A. After the subdivision or land development plan has been duly recorded,
the streets, parks, and other public improvements shown thereon shall
be considered to be a part of any official map which is adopted by
the Borough in accordance with Article IV of Act 247.
B. Streets, parks, and other public improvements shown on a subdivision
or land development plan to be recorded may be offered for dedication
to the Borough by formal notation thereof on the plan; or the owner
may note on the plan that such improvements have not been offered
for dedication to the Borough.
C. Every street, park or other improvement shown on a subdivision or
land development plan that is recorded, as provided herein, shall
be deemed to be a private street, park or improvement until such time
as the same has been offered for dedication to the Borough, and accepted
by ordinance or resolution, and recorded in the office of the Clerk
of Courts of Bucks County, or until it has been condemned for use
as a public street, park, or other improvement.
