Article XVII: Modifications to Swimming Pool and Spa Code

§ 70-57 Amendments to Section 101, Scope and General Requirements.

Section 101.1, Title, of the Swimming Pool and Spa Code of the City of Lewes is amended by striking "[NAME OF JURISDICTION]" and inserting "City of Lewes."

§ 70-58 Amendments to Section 105, Permits.

Section 105.4.3, Expiration, of the Building Code of the City of Lewes is amended by striking the number "180" and inserting "365" days.

§ 70-59 Amendment to Section 112, Board of Appeals.

Delete Section 112, Board of Appeals, of the Swimming Pool and Spa Code in its entirety.

§ 70-60 Amendment to Section 113, Violations.

Section 113.4, Violation Penalties, of the Swimming Pool and Spa Code of the City of Lewes is amended by striking "Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter or repair a pool or spa in violation of the approved construction documents or directive of the code official, or of a permit of certificate issued under the provisions of this code, shall be guilty of a [SPECIFY OFFENSE], punishable by a fine of not more than [AMOUNT], dollars or by imprisonment not exceeding [NUMBER OF DAYS], or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense" and inserting "Article XX Violation and Penalties."

§ 70-61 Amendments to Chapter 2, Definitions.

Section 201.3, Terms defined in other codes, of the Swimming Pool and Spa Code of the City of Lewes is amended by inserting a new sentence at the end of Section 201.3 as follows: "Where terms are explicitly defined in the Municipal Code of the City of Lewes, such definitions shall be controlling in all instances unless the context clearly requires otherwise."
