As used in this Article, the following terms shall have the meanings indicated:
ALARM SYSTEM
Any mechanical or electrical device which is designated to be actuated manually or automatically upon the detection of an unauthorized entry, intrusion, or other emergency in or on any building, structure, facility or premises through the emission of a sound or transmission of a signal or message.
ALARM USER
A person who has under his or her care, custody or control an alarm system to protect any building, structure, facility or premises.
FALSE ALARM
Any activation of an alarm system, intentionally or by inadvertence, negligence, or unintentional act, to which the Police Department responds, including, but not limited to, activation caused by the malfunction of the alarm system, except that the following shall not be considered false alarms:
1. 
When the Chief of Police determines that an alarm has been caused by damage, testing or repair of telephone equipment or lines by a telephone company, provided that such incidents are promptly reported to the telephone company.
2. 
When an alarm is caused by an attempted and unauthorized or illegal entry, of which there is visible evidence.
3. 
When an alarm is intentionally caused by the resident or proprietor acting upon a reasonable belief that a need exists to call the Police Department.
4. 
When an alarm is followed by a call to the Police Department cancelling the alarm by giving the proper information, prior to the arrival of the Police Department at the source of the alarm.
PERSON
Any individual, partnership, corporation, firm, or entity.

A. 
It shall be unlawful for any person to knowingly, or with criminal negligence, allow a false alarm to occur.
B. 
Criminal negligence shall be presumed if a false alarm occurs from an alarm in the care, custody or control of an alarm user, and that alarm user has had, within the calendar year in which the alarm occurred, six (6) previous false alarms from the same building, structure, facility or premises.

Any person who violates any provision of this Article shall be punished, upon conviction, by a fine as set forth in Chapter 100, Article III, of this Code and each violation shall be deemed a separate offense.
