No person shall stay in a parking lot between the hours of 8:00 p.m. and 6:00 a.m. with the intent to cause public inconvenience, annoyance or alarm or recklessly create a risk of public inconvenience, annoyance, or alarm. However, this section shall not be construed or used to curtail, abridge, or limit the right of any person to exercise the right of peaceful persuasion guarantee by MGL c. 149, § 24 or to curtail, abridge or limit the intent of any statute of the Commonwealth of Massachusetts.

A. 
Violators of this bylaw may be subject to a fine of $50 per violation for a first-time offense. A second violation shall be punished by a fine of $100. Third and subsequent violations shall be subject to a $150 fine.

This bylaw may be enforced by any available means in law or equity, including but not limited to enforcement by noncriminal disposition pursuant to MGL c. 40, § 21D, and §§ 1-4 and 1-5 of the Town Code.
