A. 
This chapter is adopted pursuant to home rule powers as provided for in Article VIII-A of the Maine Constitution and 30-A M.R.S.A. § 3001.
B. 
This chapter shall be known and may be cited as "Subdivision Ordinance of the Town of Wales, Maine."
A. 
The Planning Board of the Town of Wales (hereinafter called the "Board") shall administer this chapter.
B. 
The provisions of this chapter shall pertain to all land proposed for subdivision, as defined by 30-A M.R.S.A. § 4401, within the Town of Wales.
Adoption of this chapter shall repeal any and all previous subdivision ordinances and regulations of the Town of Wales. This shall not prevent the enforcement of repealed ordinances or regulations with respect to the time periods in which they were in effect.
This chapter shall not be construed to repeal any existing bylaws or ordinances, other than those specifically identified, or to impair the provisions of private restrictions placed upon property; provided, however, that where this chapter imposes greater restrictions, its provisions shall control.
Should any section or provision of this chapter be declared by any court to be invalid, such decision shall not invalidate any other section or provision.
