The Board of Trustees at their own discretion shall cause for portions of sidewalks and curbs to be inspected and any sidewalks or curbs which are found defective and in need of repair or replacement shall be clearly marked and the owner of the property shall be notified.
A. 
The following criteria shall be used by a Village Representative regarding inspection of an existing sidewalk or curb to determine whether or not a particular sidewalk or curb is to be considered conforming with Village standards and regulations or in need of repair or replacement. Additional criteria may be used as provided on the Sidewalk and Curb Application sheet as published by the Village.
(1) 
In the event that a section of sidewalk or curb has an elevation of one inch or greater between that section of an adjacent section or within the particular section itself, the section shall be deemed defective and in need of repair or replacement.
(2) 
If a particular section of sidewalk has two or more cracks which involve more than 40% of the particular section, the entire section shall be deemed defective and in need of replacement.
(3) 
If an area equal to or larger than 15 square inches is missing from a particular section of sidewalk or curb, the entire section shall be replaced.

A "section" as used for sidewalk herein shall correspond to that portion of the sidewalk between the ant-cracking lines drawn across the sidewalk and "section" as used for curb herein shall correspond to the affected area.

The Village Sidewalk and Curb Application should be filled out and approved prior to work commencing to be subject to reimbursement by the Village. The Village shall establish an annual fund for reimbursement of owner costs for sidewalk or curb repair or replacement made in that fiscal year. During the fiscal year in which inspections are made and notice is provided to the owner of the property, the property owners may be eligible for funding to repair and replace sidewalks at a rate of $5 per square foot of sidewalk and $20 per lineal foot of curb, with said reimbursement made for either up to the amount of funds established for reimbursement. Such repair and replacement will be on a voluntary basis and such work must be completed during the fiscal year in which the section is inspected. Once the amount of funds in a fiscal year has been exhausted, no further reimbursements shall be provided for that fiscal year. Reimbursements are only due for projects conduced in that fiscal year and do not carry over to a following year, however a property owner may repair or replace their sidewalk or curb without reimbursement, as long as they meet the regulations and guidelines as outlined herein.

Eligibility for the municipal funds shall expire upon the close of the construction period during the particular year in which notice is given. Only the ground which is part of the Village roadway or sidewalk easement are subject to approval for reimbursement.
Work shall be arranged by the property owner, and the contractor shall be responsible for the removal of all debris, including concrete and/or soil displaced during any such repair or replacement.
Prior to completion of the sidewalk or curb repair or replacement, a representative of the Village shall inspect the repaired and replaced sidewalk or curb to determine whether such repair and replacement shall meet the Village standards and regulations. Said standards and regulations shall be published on a form as provided and published by the Village, and said regulation specifications for standard sidewalks shall include, but not be limited to, the requirement that all sidewalks are four feet wide and four inches thick, and all curbs to match existing curb. All newly built sidewalks and curbs must be ADA compliant or like in kind, if applicable. Reimbursement for a repaired and replaced sidewalk or curbs shall only be due by the Village upon a passing inspection by the Village representative.
In the event a sidewalk or curb placed by the property owner does not meet the standards and regulations as provided by the Village, said nonconforming sidewalk or curb shall be demolished and replaced at the expense of the property owner within 90 days of removal of the nonconforming sidewalk or curb. The property owner is not entitled to additional funding based upon a nonconforming sidewalk or curb as placed by the property owner which was repaired and replaced. Failure to replace a nonconforming sidewalk or curb within 90 days may result in the Village replacing said sidewalk or curb and charging costs for the same to the property owner. If the resultant charges are not paid within 30 days of the billing, the Village Clerk will then place a lien for the charges against the property.
